Finding and. Determination
Re: Premises at 1110 West Elizabeth being Lot 2 of the Campus West Shopping Center
Finding:
Mr. Al Hockett, general contractor, has filed an application for a building
permit to allow construction of a Type IV, one -hour addition approximately 15' x
42.5' on the east end of an existingi�,non-conforming Type IV-N building of 9,825
square feet located in Fire Zone 2. The existing building and land is owned by
Mr. Jack Nicol, 530 S. College, and is used as an F-2 (retail store) occupancy.
A literal reading of Section 1603(b), U.B.C., would preclude the construction of
the addition unless the entire exterior wall on the north side of the building
were replaced with one -hour fire resistive construction.
Discussion with the Chief of the Fire Department reveals that he concurs
in a finding that the proposed construction does not increase the fire risk or
the hazard to adjacent property. If the proposed construction were a separate
building it would be permitted under the terms of the code.
Determination:
a. It':is the determination of the Chief Building Official that the addition of
638 square feet of conforming construction on an existing 9,825 square foot build-
ing is a minor addition,less than 25% of the value of the structure and thus is
governed by Section 104(d).
b. It is further, determined that the proposed addition does not markedly increase
the hazard in the event of fire or other emergent conditions. Thus a building per-
mit for the proposed construction will be approved provided the addition itself
complies with all pertinent ordinances.
