Dear Mr. Minatta:
Mr. Roy Bingman informed me that You had called him in regard to the
Certificate of Occupancy for the building at 230 Cherry Street.
The Certificate that was issued is in error in that number one it
lists a rough -in bath when in fact it should list a finished toilet room.
Secondly, the statement, "this warehouse is only suitable for occupancy
as a warehouse" is somewhat misleading. A hasty analysis indicates that
it would probably be suitable for other uses. However, if you wish to use
the building.for a use other than a warehouse you should visit with our
office and identify the. use proposed so that we may be assured that the
building as it is now constructed would, in fact be suitable for the new
use.
I could issue a corrected Certificate of.Occupancy immediately which
would solve the toilet room problem. I would Prefer to wait until you
inform me whether you wish to change the use, at which time if possible
the Certificate could include the new use.

RE: Warehouse @ 230 Cherry
Your advertisement in the October 20, 1974 Fort Collins Coloradoan.
on Pages 18 and 19 implies to the public that they can shop at the
referenced warehouse. This is misleading advertising since permitting
the public in that building would be a violation of the terms of your
building permit. I orally advised Mr. Wilkinson, your contractor of
these matters more than a month ago and he assured me that you fully
understood that the building is only suitable for occupancy as a
warehouse; and only by your employees; and these only on infrequent
occassions. Should you desireto allow public access to the building
additional sanitary facilities and other alterations are required.
I trust that you will arrange in the future to limit the use of the
building as above described.
I will be happy to explain the application of ordinance requirements
which you do not understand.
