UNOPPOSED MOTION FOR DISMISSAL OF DEFENDANT STEPHAN SPARACIO
Plaintiff, Kimberly Chancellor, by and through her attorney, David A. Lane, hereby moves
this Honorable Court for a dismissal, with prejudice, of all claims asserted by Plaintiff against
Defendant Sparacio. As grounds therefore, Plaintiff states as follows:
1. Counsel for Plaintiff conferred with counsel for Defendant Sparacio and
counsel for the City and neither oppose this Motion.
2. Plaintiff hereby moves this Court for an official dismissal, with prejudice,
pursuant to Fed.R.Civ.P. 41(a) of all claims by Plaintiff against Defendant Sparacio, each party to
bear his or her own costs and attorney’s fees.
Wherefore, Plaintiff hereby respectfully requests this Court grant this Unopposed Motion
to Dismiss, With Prejudice, each party to bear his or her own costs and attorney’s fees as to
Defendant Sparacio.
