The Third Amended Complaint fails to comply with the
Federal Rules of Civil Procedure and this Court's Local Rules.
Plaintiff has failed to file a motion to amend, or to file a notice
of filing of amended pleading with Defendants' written
consent, under Fed. R. Civ. P. 15(a). Moreover, pursuant to
D.C.COLO.LCivR 15.1, a party filing an amended pleading or
who has filed a motion for leave to amend, must include a
redlined version of the proposed amended complaint, which
strikes through the text to be deleted and underlines the text to
be added. Plaintiff has failed to do so here, and also has
apparently failed to confer with Defendants under
D.C.COLO.LCivR 7.1(a). Accordingly the 35 Third Amended
Complaint is STRICKEN. The Clerk of Court is instructed to
mail a copy of this Order to Plaintiff. SO ORDERED, by
