Dear Judge Lowenbach:
In a letter dated June 23, 2018, Chief of Staff Mindy Masias assigned you
to two cases in the 8th
Judicial District, 18CV30567, The Town of Timnath,
et al v. Eric Sutherland and 18CV149, Eric Sutherland v. City of Ft. Collins
and Town of Timnath, due to representation that the judges of the Eighth
Judicial District had disqualified themselves from the cases. The files of
the Senior Judge program director, Troy Singleton, indicate that you were
notified of and accepted these assignments on June 13, 2018. On July 9,
2018 the district administrator notified you and Troy Singleton, among
others, that she was mistaken about all the judges recusing on Case No.
18CV149 and asked that you be removed from that case. It is my
understanding that you never worked on Case No. 18CV149. While you
were removed that case, due to a clerical error no letter was sent
formalizing your removal.
Therefore, I am hereby formally rescinding your assignment to Case No.
18CV149 in the Eighth Judicial District effective nunc pro tunc to June 13,
2018.
