Regarding the Invocation of Psychotherapist-Patient Privilege. Pursuant to
the direction of the presiding judge, the Honorable Lewis T. Babcock, this
matter has been referred to this Magistrate Judge for resolution within the
discovery context in which it first arose. Accordingly, the Parties are to
adhere to the briefing schedule set by this Magistrate Judge
in 24 Courtroom Minutes/Minute Order in lieu of the schedule issued by
Judge Babcock in 26 Minute Order setting briefing schedule. Defendant is
ORDERED to specifically identify any case authority that permits him to
continue to seek mental health records of Plaintiff in light of Plaintiff's
waiver of any claim for emotional distress in this action. By Magistrate
