MOTION TO WITHDRAW AS ATTORNEY OF RECORD FOR PLAINTIFF
COMES NOW, John R. Duval of the Fort Collins City Attorney’s Office, counsel for
Plaintiff City of Fort Collins (the “City”), who whereby moves the Court for an Order allowing
him to withdraw as counsel of record in this action and states in support as follows:
1. I am retiring from my employment with the City and November 17, 2023, is my
last day of employment with it.
2. My co-counsel in this action, Case Collard, Maral Shoaei, and Andrea Wechter of
Dorsey & Whitney LLP, will continue to represent the City.
3. Plaintiff has received notification of this proposed withdrawal.
4. Because of the continuing representation of the City in this action by my co-counsel
from Dorsey & Whitney LLP, I have not notified the City that it is responsible for complying with
all court orders and time limitations, nor that it is required to obtain legal counsel, as would
otherwise be required by D.C.COLO.LAttyR5(b).

5. Certificate Pursuant to D.C.COLO.LCivR.7.1: Because this motion is brought
pursuant to D.C.COLO.LAtty5(b), conferral is not required. See D.C.COLO.LCivR7(b)(4).
WHEREFORE, undersigned counsel respectfully requests that the Court grant this Motion
and permit me to withdraw as counsel for the City in this action.
