U.S. District Court - District of Colorado District of Colorado Notice of Electronic Filing The following transaction was entered on 10/4/2023 at 8:08 AM MDT and filed on 10/4/2023 Case Name:City of Fort Collins v. Open International, LLC et al Case Number:1:21-cv-02063-CNS-SBP Filer: Document Number:260(No document attached) Docket Text: MINUTE ORDER: During the Trial Preparation Conference held September 29, 2023, the Court took under advisement Plaintiff's request to compel Defendant's Rule 30(b)(6) witnesses to testify at trial during Plaintiff's case-in- chief. Having considered such request, it is DENIED. Rule 30(b)(6) governs discovery procedures only and does not purport to address, nor compel, trial testimony. The duties of a Rule 30(b)(6) witness do not extend beyond discovery and such witness cannot be compelled to testify at trial absent a subpoena. See, e.g., Bell v. Boeing Co., No. 20-cv-1716, 2022 WL 1607935, at *5 (W.D. Wash May 20, 2022). Plaintiff did not issue trial subpoenas to these witnesses. Plaintiff may, however, designate portions of the respective Rule 30(b)(6) witnesses' deposition to be read during its case. Should it choose to do so, the deposition designations and objections of both parties must be filed on or before October 13, 2023. By Judge Charlotte N. Sweeney on 10/4/2023.
