1 While Appellant has named several Fort Collins’ employees in the case
caption, the Appellant did not bring any allegations against these individuals in the
operative Second Amended Complaint. [ECF 74, pp. 8-9]. The District Court
accepted Appellant’s Second Amended Complaint as to the following five
Defendants only: State of Colorado, City of Fort Collins, the CSU Board of
Governors, Colorado State University, and Steven Vasconcellos. [Id.]. The only
