JOINT MOTION TO CLARIFY RULE 702 BRIEFING ORDER, DKT. 131
Plaintiff City of Fort Collins (the “City”) and Defendants Open International, LLC and
Open Investments, LLC (collectively, “Open”), through their respective counsel, hereby submit
this joint motion for clarification of the Court’s Order regarding page limitations and reply briefs
for motions under Fed. R. Evid. 702.
1. On November 8, 2022, the Court entered an amended scheduling order setting
December 19, 2022 as the deadline for Rule 702 motions. Dkt. 107.
2. On December 15, 2022, the parties filed a stipulated motion to, among other
things, enlarge the page limit for Rule 702 motions and response briefs from 15 pages to 25
pages and reply briefs from 10 pages to 15 pages. Dkt. 121.
3. On December 19, 2022, the City filed one Rule 702 motion and Open filed two

Rule 702 motions. Dkts. 123, 128, 129.
4. On December 21, 2022, the Court issued an order denying the page-extension
request and limiting Rule 702 motions and response briefs to 15 pages and dispensing with reply
briefs; the Court, however, did not order the parties to revise and re-file their already-filed
Rule 702 motions in that Order, and the Court ordered a January 30, 2022 reply brief deadline
for a fourth Rule 702 motion by the City, in granting the related schedule extensions for that
fourth 702 motion briefing. Dkt. 131.
5. Accordingly, the parties respectfully request clarification of the Court’s Order,
specifically:
a. Whether the parties are to re-file their three Rule 702 motions to comply
with the Order’s 15-page limit and, if so, whether that revised briefing
should follow the briefing schedule for the fourth Rule 702 motion set in
Dkt. 131 (i.e., revised motions by January 6, responses by January 20,
2022).
b. Whether the fourth Rule 702 motion is, like the first three 702 motions,
similarly restricted to a motion and response, with no reply briefing.
6. Consistent with Civ. Practice Standard 7.1A(a)(1), the parties submit by email
herewith a proposed order.

This matter comes before the Court on the “Stipulated Motion to Clarify Rule 702
Briefing Order, Dkt. 131,” filed by the Plaintiff and the Defendants in this case. Having been
fully advised on the matter, the Court hereby GRANTS the Motion and ORDERS THAT:
• _____ The parties need not revise and refile their existing Rule 702 motions, Dkts. 123,
128, 129, but must comply with the page limits set forth in the Court’s Order, Dkt. 131,
for all Rule 702 filings after the date of that Order; OR
• _____ The parties need to revise and refile their existing Rule 702 motions, Dkts. 123,
128, 129, to comply with the Court Order’s 15-page limit by January 6, 2023, with
responses due by January 20, 2023.
