STATUS REPORT
The parties, by and through undersigned counsel, hereby submit the following
status report pursuant to this Court’s order, [Doc. #183], and state as follows:
1. The United States Court of Appeals for the Tenth Circuit issued an
opinion in this case on November 9, 2022. [Doc. #185]. On December 27, 2022, the
Tenth Circuit issued its mandate as to this case thereby transferring jurisdiction back to
this Court. [Doc. #264].
2. On appeal, the Tenth Circuit reversed this Court’s judgment denying
Defendant Klamser’s motion for summary judgment based on qualified immunity.
Previously, this Court denied summary judgment to Defendant Fort Collins, Colorado.
[Doc. #154]. Therefore, Plaintiff’s claim against Defendant Fort Collins remains and is
ready for a trial by jury.
3. The parties request that this Court reopen this case and set it for trial.
