Defendant(s)COUNCIL OF THE CITY OF FORT COLLINS COURT USE ONLY Case Number:2022CV30661 Division:5A Courtroom: Order Granting Intervenor's Motion to Intervene This matter is before the Court on the motion of Intervenors Solitaire Homes, East, LLC and Solitaire Homes, LLC to intervene in this matter. Plaintiffs oppose the motion to intervene. Defendant City of Fort Collins does not oppose the motion. The Court has reviewed the motion, responses filed by Plaintiffs and the City of Fort Collins as well as the reply filed by Intervenors. Based upon a review of the pleadings in this matter the Court finds that Intervenors motion should be granted. C.R.C.P. Rule 24(a) provides, in relevant part: (a) Intervention of Right. Upon timely application anyone shall be permitted to intervene in an action: (1) When a statute confers an unconditional right to intervene; or (2) when the applicant claims an interest relating to the property or transaction which is the subject of the action and he is so situated that the disposition of the action may as a practical matter impair or impede his ability to protect that interest, unless the applicant's interest is adequately represented by existing parties. The court finds that Intervenors should be permitted as a matter of right to intervene in this matter. The court is persuaded that Intervenors have established the requirements for intervention under C.R.C.P. 24(a)(2) set forth above. Further, the court finds that permissive intervention would be proper in this matter under C.R.C.P. Rule 24(b). Accordingly, Intervenors motion to intervene is hereby granted.
