This matter is before the Court sua sponte. Time is of the essence in this action. The Court, therefore, exercises its discretion
to manage this action to ensure its speedy and just disposition. Colo. R. Civ. P. 1. To do so, the Court must set the following
deadlines and address other matters.
Defendants shall file a reply, if any, to their motion to dismiss no later than noon on January 26, 2021. (In the alternative,
they shall notify the Court's CJA if they're not filing a reply by noon on January 25, 2021.)
Further, defendants shall file their response to the motion for summary judgment on January 27, 2021, and the City shall file
a reply no later than 5 p.m. on February 1, 2021. No extension of time of any of the above deadlines will be granted.
Lastly, at the case management conference, the parties must confer in good faith and must be prepared to address whether
they agree to entry of partial judgment as requested in the complaint as to sections 3 and 4 (subject to the City's exception to
the "cease acquisition efforts" clause in section 4) of the initiated ordinance.
