WAIVER AND ACCEPTANCE OF SERVICE OF SUMMONS AND FIRST
AMENDED COMPLAINT
I, John R. Duval, as Deputy City Attorney for the City of Fort Collins, hereby accept service
of process and waive formal process thereof, and agrees on behalf of the City of Fort Collins, that
this acceptance is effective service of the Summons, Civil Case Coversheet, and First Amended
Complaint as if the City had been personally served therewith by a private process server or Sheriff
within the State of Colorado. Such waiver is only in the action herein styled Stuward Cross and
Katrina Richman v. City of Fort Collins, Case No. 20CV30363, in the Larimer County District
Court.
I agree to save the cost of service of a summons in this lawsuit by not requiring that I (or the
entity on whose behalf I am acting) be served with judicial process in the manner provided by Rule
4 of the Colorado Rules of Civil Procedure.
