ORDER RE: PRO SE LETTER (DOC. 71) ______________________________________________________________________ This matter is before the Court on Plaintiff’s Letter filed February 5, 2018 (Doc. # 71), wherein he requests that this Court grant him until February 9, 2018 to file an objection to the Recommendation of Magistrate Judge Scott T. Varholak (Doc. # 62). The Recommendation issued on December 13, 2017, and this Court affirmed and adopted it on January 3, 2018. For the following reasons, the Court denies Plaintiff’s request. Plaintiff only basis for requesting an extension is that he was not informed of the Recommendation until January 26, 2018. The Court however finds that the Recommendation was properly and timely mailed to Plaintiff at the address that Plaintiff provided: Larimer County Detention Facility, 2405 Midpoint Drive, Fort Collins, CO 80525 (Doc. # 62). It was returned as undeliverable on December 29, 2017. (Doc. # 65). D.C.COLO.LCivR 5.1(c) states, in pertinent part: Case 1:17-cv-00884-CMA-STV Document 76 Filed 02/14/18 USDC Colorado Page 1 of 2 (c) Formatting and Filing of Pleadings and Documents and Maintenance of Contact Information by an Unrepresented Prisoner or Party. If not filed electronically, an unrepresented prisoner or party shall use the procedures, forms, and instructions posted on the court’s website. If the unrepresented party is a prisoner and is unable to access the website, on request the clerk shall provide copies of the necessary procedures, forms, and instructions. Notice of change of name, mailing address, or telephone number of an unrepresented prisoner or party shall be filed not later than five days after the change. A user of CM/ECF shall keep his/her primary and alternative e-mail address current. Instructions for a user to update and maintain his/her CM/ECF account. Accordingly, it was Plaintiff’s responsibility to inform the court of any changes to his address. Yet, Plaintiff failed to do so in a timely manner and has not provided any justification for his failure to do so. His request for an extension of time is therefore DENIED.
