JASON SHUTTERS, Defendant. ORDER Entered By Magistrate Judge Scott T. Varholak This matter is before the Court on Defendant’s Motion for Extension of Time to File Proposed Scheduling Order and Continue Scheduling Conference (the “Motion”). [#39] In the Motion, Defendant states that he “intends to move to dismiss Plaintiff’s claims, assert the doctrine of qualified immunity, and move to stay these proceedings accordingly.” [Id. at ¶ 7] Defendant thus requests that the Scheduling Conference and attendant deadlines be continued. [Id. at ¶ 8] The Court finds that judicial economy and the resources of the parties would best be served by resolving Defendant’s forthcoming motion to stay prior to conducting a Scheduling Conference in this matter. Accordingly, the Motion is GRANTED IN PART AND DENIED IN PART. The Scheduling Conference set for September 15, 2017 at 10:00 AM is VACATED to be reset, if necessary, after resolution of Defendant’s forthcoming motion to stay. Defendant shall file any motion to stay on or before September 20, 2017, and Defendant shall file his response within twenty-one days of the filing of the motion to stay. A Telephonic Status Conference is SET for October 25, 2017 at 10:00 AM. The parties may participate in the conference by calling the Court at 303.335.2365 at the scheduled time. SO ORDERED.
