DEFENDANT’S STATUS REPORT IN RESPONSE TO THE COURT’S
DELAY PREVENTION ORDER DATED 11/21/2024
COMES NOW, Defendant Evan Gilmartin, by and through his counsel Fischer Law
Group, P.C. and hereby files this Status Report to update this Honorable Court and state as follows:
1. On November 12, 2024, Defendant’s Counsel’s office mailed to the Court
Administrator of the Municipal Court a check in the amount of $500.00 for the transcript deposit
fee. See Exhibit A (transmittal letter).
2. On November 21, 2024, this Honorable Court issued a “Delay Prevention Order”
noting that “the Record in this appeal has not been perfected apparently due to fees being owed to
the City of Fort Collins for preparation of the transcript.”
3. After several unsuccessful attempts in reaching the Municipal Court Clerk’s office
to get status, Defendant’s Counsel’s office was able to connect with a clerk to assist.

4. The clerk confirmed that Defendant’s Counsel’s check was received by their office,
but was subsequently misplaced within their office. This caused an unanticipated delay in the
Court’s receipt and processing of the deposit payment.
5. On November 21, 2024, Defendant’s Counsel’s office was informed by the
Municipal Court clerk’s office that the check was located and the payment had been properly
entered into the Court’s system.
