In support thereof, Appellee states as follows: Defendants-Appellants Open International, LLC and Open Investments, LLC (“Appellants”), filed their Opening brief on November 14, 2024. App. Dkt. 46. Pursuant to the Court’s September 24, 2024 Order, Appellee’s Answer brief is currently due on December 16, 2024. App. Dkt. 44. Due to various scheduling conflicts and the issues raised in Appellants’ Opening brief, Appellee needs additional time to fully respond. Appellee must also review and analyze the District Court record to identify any additional documents relevant to its brief—an extensive record that includes a two-week jury trial, hundreds of exhibits, and extensive post-trial motions practice. This is Appellee’s first request for an extension, and it is being sought in good faith. Appellants do not oppose the relief requested herein. CONCLUSION For the foregoing reasons, the City respectfully requests that the Court grant Appellee a 30-day extension of time, up to and including January 15, 2025, to file its Answer brief.
