STARNELLA This matter is before the Court on Plaintiff’s Unopposed Motion to Extend Two Remaining Scheduling Order Deadlines [ECF 112] by 45 Days [#114] (the “Motion”). This is the parties’ sixth request to amend Scheduling Order deadlines and the fourth such request since Plaintiff filed his Amended Complaint [#88]. See Motions [#69, #77, #92, #100, #110]. Plaintiff requests a 45-day extension of the discovery deadline, the Rule 702/704 motions deadline, and the dispositive motions deadline, once again invoking a discovery dispute that was first raised in June, as well as difficulties scheduling expert depositions. See Motion [#114], ¶¶ 6.A., 6.B., 9. However, the parties still have not contacted the undersigned’s Chambers to raise any disputed discovery issues. The Court will grant the requested extension, but no further extensions will be granted absent extraordinary circumstances. Moreover, the Court is concerned with the parties repeatedly invoking a months- old discovery dispute that has now caused significant delay in this case. Therefore, the Court will also set a Discovery Status Hearing. If no disputed issues remain as the hearing date approaches, the parties may move to vacate it. Therefore, IT IS HEREBY ORDERED that the Motion [#114] is GRANTED. The Scheduling Order is amended to reflect the following deadlines: Discovery Cut-off and Rule 702 Motions Deadline December 19, 2024 Dispositive Motions Deadline January 24, 2025 Case No. 1:23-cv-01343-GPG-KAS Document 116 filed 10/31/24 USDC Colorado pg 1 of 2 2 IT IS FURTHER ORDERED that that a Discovery Status Hearing is scheduled for November 15, 2024, at 11:00 a.m. in Courtroom C-204, Second Floor, Byron G. Rogers United States Courthouse, 1929 Stout Street, Denver, Colorado 80294. Attorneys who will be representing a party and who are located outside the Denver metropolitan area or who cannot reasonably make a personal appearance at a court hearing may request to appear by telephone or by videoconference. IT IS FURTHER ORDERED that the parties shall familiarize themselves with the undersigned’s Discovery Dispute Hearing Procedures, which are posted on the Court’s website at www.cod.uscourts.gov.
