As grounds therefore, the City states as follows: CONFERRAL PURSUANT TO C.R.C.P. 121 § 1-15(8) Undersigned counsel certifies that she conferred with counsel for Respondents Horsetooth Convenience Center, LLC and 7-Eleven Inc. (the "Respondents") concerning this Motion and counsel for Respondents do not oppose the relief sought by this Motion. A voir dire of the commissioner-nominees is set for October 25, 2024 in this case for the March 11-14, 2025 valuation trial. The sole issue for the commissioners at the valuation trial is to ascertain the compensation owed by Petitioner to Respondents for the taking of the subject property. 2. Petitioner and Respondents are actively working toward a possible settlement of the compensation issue. The parties hope to reach a settlement that will not only resolve the need for the valuation trail, and thereby the voir dire hearing, but will also avoid or reduce the need for ongoing litigation related to this condemnation proceeding. 3. As such, in order to conserve judicial resources and to save the parties' expense and time associated with litigation, including the commissioner-nominees' time, Petitioner requests a continuance of the October 25, 2024 voir dire hearing. 4. Should the Court grant this Motion, Petitioner will contact the Court Clerk to obtain voir dire hearing dates available in January 2025 or thereafter and will coordinate those dates with Respondents and the commissioner-nominees. 5. There is good cause to grant this Motion and it is not being filed for purposes of unwarranted delay or any other improper purpose. WHEREFORE, Petitioner respectfully requests the Court grant this Motion to Continue Voir Dire Hearing. A proposed order is filed herewith. Dated this 21st day of October, 2024.
