This matter is before the Court on the parties’ Joint Motion to Amend Scheduling
Order (ECF 35) Regarding Discovery Deadlines [#110] (the “Motion”). This is the fifth
request to amend Scheduling Order deadlines and the third such request since Plaintiff
filed his Amended Complaint [#88]. See Motions [#69, #77, #92, #100].
The parties request a 90-day extension of remaining discovery deadlines due to
ongoing discovery efforts. See Motion [#110], ¶¶ 5-9.1 They indicate that “there are
incoming discovery disputes related to written discovery and depositions that now appear
certain to require Court assistance and a hearing.” Id., ¶ 9. However, the parties have not
contacted the undersigned’s Chambers to address any disputed discovery issues.
Therefore, the Court is not inclined to grant such a long extension, given the number of
prior extensions granted. Instead, the Court will grant a 60-day extension. Accordingly,
IT IS HEREBY ORDERED that the Motion [#110] is GRANTED IN PART and
DENIED IN PART. The Scheduling Order is amended to reflect the following deadlines:
Plaintiff’s Rebuttal Expert Disclosure August 27, 2024
Discovery Cut-off and Rule 702 Motions Deadline November 4, 2024
Dispositive Motions Deadline December 10, 2024
1 The parties only request a three-week extension of Plaintiff’s rebuttal expert deadline. See
Motion [#110], ¶ 9; Minute Order [#102] (previously setting deadline of August 6, 2024). The Court
grants that extension.
