Petitioner City of Fort Collins (“Petitioner”) and Respondents Horsetooth Convenience
Center, LLC and 7-Eleven Inc. (collectively, the “Parties”) hereby submit the following Stipulated
Motion for a Protective Order.
1. Rule 26(c) provides that “the court may, for good cause, issue an order to protect a
party or person from annoyance, embarrassment, oppression or undue burden or expense.” The
Parties request entry by the Court of the Stipulated Protective Order filed herewith.
2. The Parties’ Stipulated Protective Order is designed to preserve the confidentiality
of anticipated testimony and certain documents or correspondence exchanged or produced in this
matter. The Stipulated Protective Order is necessary to expedite the flow of discovery and
litigation in this matter, facilitate the prompt resolution of disputes over confidentiality, and
safeguard the confidentiality of information and documents to be produced and disclosed during
discovery.
WHEREFORE, the Parties request this Court enter the Stipulated Protective Order (filed
herewith).
