DocuSignEnvelopeID:3D3F038D-DS9D4FE7-98FE-5D120663328EIll.StipulationRegardingDecreeofQuietTide8.TheDisputedPropertyliesadjacenttothePleasantValleyandLakeCanal(“Canal”),whichPVLCownsandmaintains,Historically,PVLChasusedpartsoftheDisputedPropertyforaccesstoandmaintenanceoftheCanal.9.TheCityandPVLCagreethatPVLChasexistingrightstoaccessandmaintaintheditchusingParcelsIandII,andtheCitydoesnotintendtoeliminateorinterferewiththoserightsthroughthisaction,ParcelsIandIIaredepictedonExhibitItothisStipulation.10.OtherthantheaccessandmaintenancerightssetforthinParagraph9,theCityandPVLCagreethat,astoPVLC,theCityownstheDisputedPropern’infeesimpleandthatPVLChasnointerestintheDisputedProperty.ii.TheCityandVVLCrequestthat,shouldtheCourtdeterminethatfeesimpletitletotheDisputedPropertyisvestedintheCity,thatthedecreequietingtitleshallincludelanguagesubstantiallysimilartothefollowing:ThisDecreedoesnotextinguishorinterferewiththePleasantValleyandLakeCanalCompany’sexistingtightstoaccessandmaintaintheditchusingtheDisputedProperty.IV.MiscellaneousProvisions12.ThepartiesacknowledgethatthisStipulationshallonlybeeffectiveiftheCourtdeterminesthattheCityisvestedwithfeesimpletitletotheDisputedProperty.IftheCourtdeterminesthattheCitydoesnothavefeesimpletidetotheDisputedProperty,thisStipulationshallhavenoforceandeffect,atnofaulttoeitherparty.13.Eachparty,bysigningbelow,representsithaslegalauthoritytoenterintothisStipulation,tobindthepartytothisStipulation,anddoessovoluntarilyandknowingly.14.ThisStipulationmaybeexecutedincounterparts,eachofwhichshallbedeemedanoriginal,andallofwhichtakentogethershallconstituteoneandthesameinstrument.Electronicallytransmittedsignaturesshallbeeffectiveasoriginals.iS.OncetheStipulationisfullyexecuted,thePartiesauthorizecounselfortheCitytofilethisdocumentwiththeCourt.16.ThisStipulationshallbebindinguponandinuretothebenefitofthepartiesandtheirrespectiveheirs,legalrepresentatives,successorsandassigns.17.EachpartytothisStipulationshallpayitsowncostsandfees.3
