Schapanski on the 14th day of April, 2022, at 1:00 p.m. The parties and counsel shall meet at Judicial Administration located on the first floor of the Justice Center to be escorted to an available conference room. A settlement conference is a non-adversarial proceeding in which each party is encouraged to consider not only the merits of the opposing case but also the merits and weaknesses of his or her own case. The parties and their attorneys must approach the settlement conference with the goal of attempting to reach a compromise resolution. A candid non-adversarial confidential settlement statement shall be e-mailed at least 7 days prior to the settlement conference to Judge Schapanski at: stephen.schapanski@judicial.state.co.us Statements shall not be exchanged between the parties and copies shall not be sent to the court. Statements shall be limited but should include a brief non-argumentative analysis of the facts, the claims and defenses, an evaluation of damages, a summary of settlement negotiations to date and a frank disclosure of settlement authority. Such disclosure may be in monetary terms or other relief that is sought. In addition, the settlement statements may include copies of contracts or documents at issue, exhibits or brief portions of depositions. It is not necessary to include any documents that have already been filed in the case. COURT USE ONLY DATE FILED: March 2, 2022 4:25 PM CASE NUMBER: 2021CV30613 2 The settlement statements shall be protected from disclosure pursuant to Rule 408 of the Colorado Rules of Evidence. Each party and their counsel shall be personally present at the settlement conference and be prepared to spend as much time as is reasonably necessary to pursue a reasonable settlement. If a party does not have unqualified authority to settle the case, whoever does have this authority must appear in person or be available by phone. Dated this 2nd day of March, 2022.
