Event staff member Jackie Davison of the Lincoln Center urgently waved me to her location reference a
disorderly male suspect in attendance of a private party at the Lincoln Center. I contacted the suspect with the
assistance of Officer Barnes. I instructed the suspect to leave the building and the property. The suspect
remained on the property so he was recontacted by myself and Officer Barnes. The suspect was again instructed
to leave the property, but refused. When I asked him for his identification, he also refused. When I told him to
stop, he continued to walk away from me. When I told the suspect he was under arrest, he said"no I'm not", and
continued to walk away from me. I applied a single baton strike to his lower right leg. The suspect turned toward
myself, and officer Barnes. I thought he was going to advance on Officer Barnes and I, so applied oleoresin
capsicum to the suspect's face. The suspect fled from the scene, and after a short foot pursuit, was safely taken
into custody and booked at the Larimer County Jail.

On December 3rd, 2016 at 7:30 PM, Officer Barnes and I began working an off-duty job assignment at the
Lincoln Center at 417 W. Magnolia. This was a sorority holiday formal for Kappa Delta. Both Officer Barnes, and I
were in full police uniform. At approximately 9:30 P.M., Jackie DAVISON, who is the concessionaire for the
Lincoln Center, yelled to me across the foyer and waved me over to her location. DAVISON was engaged in
some sort of conflict with suspect Sean SLATTON. I observed some sort of verbal altercation between DAVISON
and SLATTON, and there was clear concern and urgency to DAVISON waving me to her. It was obvious she
needed me to me to intervene in this conflict. SLATTON was a tall male, with a thin beard, and wearing a dark
colored suit. DAVISON told me he "got in my face". DAVISON then yelled at SLATTON, and pointed SLATTON
towards the door stating, "I'm done". This indicated to me, SLATTON was being ejected from the event. Officer
Barnes, and I approached SLATTON. I stood in front of him and I told him he needed to leave the building, and
the property. At first, he was resistant to my instruction and just stood there. He said something, but I could not
understand exactly what it was. I repeated my instructions to SLATTON, and told him he needed to leave
immediately or he would face criminal charges. SLATTON walked toward the doors, then exited the building. He
remained right out side the double doors. Officer Barnes and I re-contacted SLATTON outside the doors of the
Lincoln Center.
I asked SLATTON if I was unclear about the instructions I gave him to leave the building, and the property.
SLATTON already had a confrontation with staff, and was reluctant to comply with my instructions. I was
concerned if SLATTON lingered on the property after he had been trespassed there was a high likelihood
SLATTON cause another incident, or disturbance. Again, I asked him if I was unclear about my instructions for
him to leave the property, then reinforced he needed to leave. He continued to argue with me and Officer Barnes.
I then asked SLATTON for his identification. SLATTON refused, turned, and began to walk away from me. I
asked him again for his identification and told SLATTON to stop several times. SLATTON refused.
Due to his lack of compliance, I told SLATTON was under arrest. SLATTON continued to walk away from me,
and replied "No I'm not". He continued walking, and his hands were concealed. In response to his resistance; I
struck SLATTON in the lower right leg with my straight baton one time. He reacted by spinning back around in an
aggressive stance and I immediately applied oleoresin capsicum to his face at an estimated distance of eight
feet. He yelled something to the effect of "mother-fucker", spun around and sprinted away eastbound on
Magnolia, crossing Meldrum then on into a nearby parking lot, then behind some businesses. Officer Barnes and
I made announcements over the radio that we were in a foot pursuit and gave last known direction of travel of the
SLATTON. Area officers later caught the SLATTON in the 400 block of S. Mason.
Officer Klamser picked me up in his patrol car nearby, and drove me to the scene where SLATTON was taken
into custody. SLATTON was being medically treated there for exposure to oleoresin capsicum, and a baton
strike. I positively identified him as the suspect from the sorority formal , and reported my contact, and
use-of-force to Sergeant Heather Moore. I returned to the Lincoln Center, and authored a written narrative
containing the details of the contact with SLATTON. Officer Michael Harres remained with SLATTON as he was
transported to the hospital for medical clearance. I provided the narrative to Officer Harres for the booking
process.

Narrative
I returned to the Lincoln Center, and spoke with DAVISON. She told me she spoke to SLATTON near the
restrooms, and asked him something about him possibly having a flask. He responded aggressively by lunging
toward her in a taunting fashion, and made a movements as if he was going to grab her by the shoulder or the
arm. Ms DAVISON is small in stature, and this suspect is quite large; standing over six-foot, and in the
neighborhood of 200-plus pounds! The size disparity between him and Ms. DAVISON is significant.
I was later approached by Lauren TEW. She is STRATTON's girlfriend. She asked me if I knew the whereabouts
of her phone. TEW asked me if she saw STRATTON with it. She described her phone as a large pink "glittery"
smart phone. She further described the phone as having a sticker or graphic on it that something to the effect of
"glitter is my life". I told her I did not recall that specific phone. I agreed to contact Officer Harres, and ask him if
that phone was perhaps in STRATTON's property at the hospital. Miss TEW seemed alarmed when I informed
her STRATTON was at the hospital. I briefly explained to her, that I was forced to strike STRATTON, and as a
matter of policy he is required to medically evaluated. She became slightly emotional, and told me STRATTON
was an "asshole", and described him something to the effect of a douche-bag" She told me she had a discussion,
and warned him about his behavior at tonights formal. She explained further he has been her boyfriend for a
couple of weeks, and indicated the relationship was over. At one point during this conversation, after she had
expressed her disapproval of STRATTON's actions, she asked me if she could "give me knuckles". I replied I did
not think that was appropriate, but I knew where she was coming from. Officer Harres soon informed me TEW's
phone was with STRATTON at the hospital. I relayed this information to TEW, and told her she could recover it
from the emergency room, and that officers were expecting her arrival.
Officer Barnes assisted in speaking with Jackie and other witnesses at the scene. Please refer to Officer Barnes'
supplemental report for additional information. This suspect was jailed on charges of Trespass, Obstructing, and
Resisting Arrest.
During this contact, I activated my Axon point-of-view camera, and footage of this contact has been uploaded to
evidence.com under this case number as item FC165-1.

On 120316 at 2126, Officer Hopkins reported a trespass of a white male (later identified as Sean SLATTON) at
the Lincoln Center located at 417 W. Magnolia Street. During the contact, SLATTON ran away from Officer
Hopkins and did not comply with his commands.

Narrative
At this time, Officer Harres and I were on directed foot patrol in the District One area of Old Town; therefore, we
responded to the scene to act as perimeter units in an attempt to locate SLATTON. Officer Harres and I arrived
on the north side of the US Bank located at 400 S. Howes Street. As we did, Officers advised they were in
contact with SLATTON on the south side of the US Bank. When I walked around to the south side of US Bank, I
observed Officer Schuh and Officer Klamser had taken SLATTON into custody in an adjacent parking lot located
to the east of US Bank. SLATTON was exposed to OC spray during his contact with Officer Hopkins.
Subsequently, SLATTON was transported to Poudre Valley Hospital (PVH) prior to being booked on several
charges at the Larimer County Detention Facility (LCDC). As SLATTON was in custody, Officer Harres
accompanied SLATTON and medical personnel on the ambulance during the ride to PVH.
Shortly thereafter, I met Officer Harres at PVH with my marked patrol unit. While on-scene at PVH, SLATTON's
girlfriend, Lauren TEW, arrived to retrieve some of her belongings. I met with TEW in the Emergency Room lobby
and provided her with her cell phone (Iphone) and her Hilton room key. Both items were previously in SLATTON's
possession. Once SLATTON was medically cleared by PVH staff, I transported SLATTON to LCDC with Officer
Harres. Upon arrival at LCDC, I completed the Part One Booking Form and Summons for SLATTON. SLATTON
was charged with Third Degree Criminal Trespass, Obstructing a Peace Officer and Resisting Arrest.
At no time during my involvement in the incident did I speak directly with SLATTON.
This officer had no further involvement.

On December 3, 2016, I was working an off-duty security job at the Lincoln Center, located at 417 W Magnolia
St, along with Officer Hopkins.
A female who was later identified as Jackie DAVISON said something along the lines of this guy is done or get
him out of here. At that time Officer Hopkins and I went over towards a male who was inside the Lincoln Center,
but outside of the actual event room. I activated my Taser axon point of view camera. The following is a synopsis
of my involvement and observations. For additional information and exact quotes please see the associated axon
videos which are to be uploaded to Evidence.com.
The male was told to leave the property by Officer Hopkins and he walked out of the building. The male was
standing on the property outside of the doors to the Lincoln Center, and Officer Hopkins and I went outside.
Officer Hopkins asked him something along the lines of what was the property part that he did not understand.
The male said that he was waiting for his ride. Officer Hopkins told the male that he needed to leave the property
in its entirety, and the male said that he will. Officer Hopkins asked the male for his ID, and the male asked back,
for what reason. Officer Hopkins told the male that he was detaining him for trespass. The male then said that he
was leaving right now. The male began walking away towards Magnolia St. Officer Hopkins told the male to stop.

Narrative
The male had his cell phone out, and appeared to be trying to activate the camera feature to record. Officer
Hopkins told the male again to stop, and that he was under arrest. The male continued to walk away. I told the
male to stop. Officer Hopkins used his straight baton and applied a strike to the male's lower right leg. The male
turned around and Officer Hopkins applied OC (oleoresin capsicum) to the suspect. The male took off running
eastbound along W Magnolia St and so did officers. Information was relayed via the police radio regarding this. I
stayed on the north side of the Lucile's restaurant, and a short time later was able to see the suspect running
along Magnolia again only further to the east, towards College Av. I later heard that other officers had the male in
custody. The male was later identified as Sean SLATTON.
I went back to the Lincoln Center and arranged to speak to DAVISON inside. I went to my vehicle and grabbed a
notepad so I could interview her. I was able to speak to DAVISON and she said that the girlfriend of SLATTON,
who was later identified as Lauren TEW washed the X's (markings to indicate underage) off of her. DAVISON
reported that TEW was with SLATTON and that SLATTON is over 21. DAVISON said that a someone said that
SLATTON had a flask on him. She said that this information was relayed to her twice. She reported that TEW got
upset and went to the bathroom and was in the bathroom crying. She said that SLATTON had his back against
the wall and was mad at DAVISON because she gave her, referring to TEW, the X's. DAVISON said that
SLATTON stopped her and got confrontational with her. DAVISON reported that SLATTON went to grab her but
never touched her, and she said that she yelled that he needs to leave. She indicated that she was a little scared
but not enough to feel threatened. DAVISON said that she thought that he was going to grab her arm. DAVISON
told me that a female named Ruth was by her during this time.
I was later able to speak to the Ruth that DAVISON was referencing. Ruth was identified as Ruth SMITH. Ruth
reported that she saw a male yelling at her, referring to DAVISON'S face. She said that she would not classify the
distance though between SLATTON and DAVISON as in DAVISON'S personal space when she saw. She said
that her understanding was that he (SLATTON) was asked to leave. Ruth said that it looked like SLATTON was
confronting DAVISON due to the tone of his voice and the volume.
I was able to speak to another female that was a concierge there at the Lincoln Center. She identified herself as
Laura SMITH. Laura reported that TEW was crying and went to the bathroom. Laura said that SLATTON was just
standing against the wall and that DAVISON went to talk to him. She said that she could tell that something was
happening but did not know what. Laura said that she heard DAVISON say that he needed to leave right now.
I was able to speak to SLATTON'S girlfriend, TEW. TEW told me that her "little", referring to the individual that
she sponsors in the sorority, drove them there tonight. TEW said that her and SLATTON are boyfriend and
girlfriend and that they have been dating for a couple of weeks. She said that she gave SLATTON her phone to
hold. TEW told me that she washed her hands and the X's came off. TEW told me that a sorority individual told
her that they were getting an Uber because SLATTON had a flask. TEW said that SLATTON did not have a flask.
TEW also said that he (SLATTON) is stupid and you don't just get angry and yell at people. TEW became very
emotional at this time. TEW said that the lady and described her as the little Asian lady (DAVISON), came up to
her in the bathroom. TEW said that she could hear SLATTON yelling, so she came out. TEW said that she put a
hand on him saying that he needed to stop. TEW said that she did not know why he would run and said he is a
"stuck up asshole from California". I asked her if she could hear what he was yelling about and she said that she
could not. She said that he is really over protective and he says stupid things.
TEW said that she told SLATTON not to cause a scene before they got there. I was informed that SLATTON was
drinking but she said not a lot. She said that he was drinking apple Ciroc and Corona. TEW said that SLATTON
was from CU-Boulder and was up here for the night. I was later informed that they were staying at the hotel.
I spoke to Officer Hopkins and he assisted in arranging for TEW to try and get her cell phone back.
I spoke to Lynette WEYAND, who works for the Lincoln Center. I spoke to her about cameras. I was informed
that a camera was inside and showed the front doors. She was able to show me what the camera picked up
inside the venue. Lynette was going to work on getting officers a copy of this video surveillance.

On 120316 at 2126 hours, Officers Brandon Barnes and Todd Hopkins aired that they were in a foot pursuit with
an individual from 417 W. Magnolia St., which is the Lincoln Center. We were getting updates as the male ran
from them eastbound on Magnolia and I drove emergent to this area and assisted in locating the suspect in this
case.
As I arrived on scene behind 415 S. Mason, Officers Klamser and Schuh were in contact with the suspect and
taking him into custody. The suspect was later identified as Sean SLATTON. SLATTON had been sprayed with
pepper spray and was complaining about being in pain. Several onlookers from the business at 415 S. Mason
were standing by and I approached them and asked them, as they were employees of the restaurant, if they had
a damp towel that they could bring out to assist Mr. SLATTON in cleaning off some of the OC (oleoresin
capsicum) spray that was on his face. The employees of the restaurant brought out a towel and I was able to
clean off SLATTON's face, and also, they brought out a cup of water and I offered him some water.
I remained on scene while SLATTON was treated and transported to Poudre Valley Hospital, and a short time
later, I was notified by Officer Michael Harres that Mr. SLATTON's cell phone was set on my patrol car by another
officer and asked me to look for it. I went back to the 415 address to look for the phone and I was unable to find
it. I was notified by Officer Harres that they were using a Find My iPhone app and the phone was now located at
the intersection of Shields St., and W. Mountain, which is in the path of where I drove after clearing this scene. I
drove to that intersection and I did find a phone lying on the ground. I collected that phone and took it back to
Officer Harres who was with Mr. SLATTON at Poudre Valley Hospital.
Upon retrieving the phone, it was shattered and damaged as if it had fallen off of my vehicle. I returned it to
Officer Harres and this ends my involvement in this case.

On 120316 at approximately 2126 hours, Officers Brandon Barnes and Todd Hopkins, who were working off duty
at the Lincoln Center located at 417 W. Magnolia St., in the city of Fort Collins, aired a foot pursuit from that
location and possibly last saw the suspect in the US Bank parking lot in the 400 block of S. Howes. Officer
Hopkins aired that he had charges of Trespass, Obstruction, and Resisting Arrest, and had been exposed to OC
(oleoresin capsicum) spray, as well as a baton strike to the lower leg.
Several officers went en route looking for the suspect; Officers Randall Klamser and Matt Schuh located him in
the parking lot near the US Bank. They placed him in custody and immediately provided first aid for the OC
exposure and baton strike. Since the suspect had already vacated the area where the OC spray was applied, he
had already been removed from the contaminated area, but they ensured he was upwind and told him to keep his
eyes open for the air to work on his eyes. Officer Dane Stratton, who also arrived, provided him a towel with
some water to wipe some of the spray from his face in addition to wiping his nose. The suspect, later identified as
Sean SLATTON, reported to officers that he had contacts in. Medical arrived on scene shortly and provided
treatment for him.
I made contact with officers on scene. Officers Klamser and Schuh, who made the contact and arrest, said they
did not use any force to effect an arrest. Officer Todd Hopkins arrived on scene a short time later and related to
me that SLATTON had some type of disagreement with his girlfriend while at the Lincoln Center. One of the
employees from the Lincoln Center told SLATTON he needed to vacate the premises. SLATTON was somewhat
argumentative with the employee, who then contacted Officer Todd Hopkins, and told him that SLATTON needed
to be trespassed and removed from the facility. Officer Hopkins removed SLATTON from the immediate area of
the Lincoln Center, but SLATTON would not remove himself from near the entryway. Officer Todd Hopkins
re-engaged contact with SLATTON after he was still refusing to vacate the entire property of the Lincoln Center.
When Officer Hopkins told SLATTON he needed to leave the property, SLATTON became argumentative with

him. At this time, Officer Hopkins informed SLATTON he was being detained for trespass and asked for his
identification. SLATTON was argumentative and did not provide his identification and began to walk away from
Officer Hopkins. Officer Hopkins told him he was under arrest and he proceeded to walk away from him. Officer
Hopkins deployed his baton and struck SLATTON in the right calf as he was turning. Officer Hopkins believed he
made contact with the muscle portion of his calf and it was rendered ineffective. At this time, Officer Hopkins
deployed his OC spray and sprayed SLATTON in the face. SLATTON ran from Officer Hopkins and officers gave
chase. They lost sight of SLATTON which is when Officers Klamser and Schuh came into contact with SLATTON
and placed him under arrest.
When SLATTON was being treated by paramedics, he was still uncooperative and therefore, restrained to the
gurney. Due to this, I decided Officer Harres would ride in the ambulance with SLATTON. Officer Harres went en
route to Poudre Valley Hospital with SLATTON, and I also went to assist. I instructed Officer Todd Hopkins to
complete an email with the details for the charging documents.
Once I arrived on scene, Officer Harres and I went in the room and spoke with SLATTON, after he was done
being medically treated. Officer Harres Mirandized SLATTON, and SLATTON provided his statement to him.
Please see Officer Harres' report for specific details. I asked a few clarifying questions of SLATTON, to include if
Officer Hopkins ever identified himself as Fort Collins Police officer or if he asked for his identification. SLATTON
denied that this ever happened. SLATTON believed Off. Hopkins was some type of security guard, even though
Off. Hopkins was fully identifiable as a police officer by the uniform he was wearing. SLATTON also said he was
never asked for his identification, which was not true. When I asked SLATTON why he ran from officers, he
related to me that he did not know who this person was and there are weird people on the street, so he felt
inclined to run. I informed SLATTON that the contact was recorded with Officer Hopkins point-of-view camera and
that would be included in the case.
SLATTON was in possession of his girlfriend's iPhone, which was eventually transferred to her at Poudre Valley
Hospital. We also provided her with a room key where she was supposed to be staying with SLATTON on this
evening.
Officer Harres explained to SLATTON he was being charged with Trespass, Obstruction, and Resisting Arrest,
and he would be booked into the Larimer County Detention Center. Officer Harres was in possession of
SLATTON's wallet, but somehow, the iPhone did not make it with Officer Harres to Poudre Valley Hospital.
Officer Harres inquired of officers on scene where this iPhone was. Apparently, Officer Klamser had placed the
iPhone onto Officer Stratton's vehicle, and unbeknownst to Off. Stratton, Off. Stratton drove away with the iPhone
on his car. Knowing this, I asked SLATTON to place his log in and password into "find my i-phone" so we could
find his iPhone. We located the phone via the GPS at Mountain and Shields; however, the phone was damaged
beyond repair. The phone was completely shattered and one could not read anything on the phone as the screen
underneath was also broken.
I took photographs of SLATTON's injury to his calf, the treatment provided for his OC exposure, and the damage
to his cell phone. The photographs are logged into Fort Collins Police Evidence under FC197-2.
I provided SLATTON with a business card with the case number and the phone number for Risk Management, as
we will have to provide a claim for the damage to the iPhone. I completed this form and forwarded it to the Risk
Management Department and told SLATTON to contact them.
At the end of the night, I was able to review the video footage from Officer Hopkins' point-of-view camera. After
reviewing the footage, I found Officer Hopkins' use of force to be within law, policy, and ethics. I also recorded my
conversation with SLATTON with my point of view camera, please see FC197-1 for specific details.
Officer Harres and Officer Ferraro transported SLATTON to the Larimer County Detention Center and
appropriately completed booking procedures.
This ended my involvement in the case.

On 120316 at approximately 2128 hours, I was on uniformed patrol working a District One assignment paired with
Officer Klamser when we assisted Officer Hopkins and Officer Barnes, who were working an off duty assignment
at the Lincoln Center, located at 417 W. Magnolia Street. The information we knew at the time was officers were
in contact with a subject, who took off running from them on foot after being contacted for trespassing and
obstructing.
Officer Klamser was driving a marked patrol vehicle and I was passenger in it when we came into the area where
the suspect was last believed to be. While checking a parking lot to the west of Restaurant 415, I noticed a male
individual fitting the description provided talking with another subject. Officer Klamser and I parked the patrol
vehicle, exited, and contacted the individual, who turned out to be the suspect, and was later identified as Sean
SLATTON.
Officer Klamser contacted SLATTON prior to me getting there and I stood by while the subject was detained in
handcuffs. After contacting SLATTON, I could see that he had OC (oleoresin capsicum) spray on his face and
appeared to be in pain from it. After Officer Klamser was able to detain SLATTON, I rolled him onto his side to try
and free his breathing. SLATTON was sat up shortly after and I stood with him and attempted to help him with
relief from the OC spray. I stood by with him while additional officers arrived on scene and an ambulance was
called to check him for injuries.
After Medical personnel arrived on scene, I stood by while he was attended to by ambulance crews. It was
determined he would be transported to Poudre Valley Hospital for treatment and SLATTON was stood up and
walked over to a nearby gurney to be placed on it. After he was placed on the gurney, it was determined he
would be taken out of handcuffs and placed into soft restraints by paramedics.
I assisted Officer Harres in taking SLATTON out of handcuffs so that paramedics could secure SLATTON in soft
restraints to the gurney.
After SLATTON was secured, my assistance was no longer needed and I cleared.
No further action was taken by this officer.

Narrative
Andy Ferraro. At approximately 2126 hours, I heard Officer Todd Hopkins air over police radio that he was in a
foot pursuit with a male who had been trespassed from the Lincoln Center, located at 417 West Magnolia Street.
Officer Hopkins described the male as a white male with blonde hair and thin beard, wearing a suit and tie.
Officer Hopkins also informed officers over police radio that he struck the male with a baton on his lower right leg
and had sprayed him in the face with OC spray.
Officer Ferraro and I responded to the area in order to assist. While en route on foot, I heard Officer Randy
Klamser air that, he and Officer Matt Schuh had the male in custody at approximately 2130 hours. I arrived on
scene shortly after and observed the male, who was later identified as Sean SLATTON, in custody in the parking
lot of 415 South Mason Street. Officer Schuh was attending to SLATTON, as he was obviously agitated due to
the OC exposure. I immediately instructed Officer Schuh to sit SLATTON up and face him in the direction of the
wind in order to start the decontamination process for the OC spray. SLATTON made several comments that his
face burned and also informed me that he was wearing contacts.
Medical personnel was requested to respond to the scene in order to provide SLATTON with medical attention
and further assist with the decontamination process. As medical personnel arrived on scene, I explained that
SLATTON had been sprayed in the face with OC and had a baton strike to his lower right leg. Prior to paramedics
arriving on scene, I observed Officer Dane Stratton assist with the decontamination process by getting a damp
towel from a nearby restaurant and whipping SLATTON's face. I also saw Officer Stratton provide SLATTON with
a drink of water. As medical personnel and paramedics arrived on scene, I assisted by walking SLATTON over to
a gurney and then assisted paramedics by with placing SLATTON into soft restraints for transport to Poudre
Valley Hospital.
While en route to Poudre Valley Hospital, SLATTON asked if I had his wallet and I informed him that I did. He
also asked me if I had his cell phone, which I was not familiar with and did not have in my possession. I check
with other officers who were on scene of 415 South Mason Street and realized that SLATTON's cell phone had
been placed onto a patrol car. I coordinated with officers to locate SLATTON's phone. I was met by Sergeant
Heather Moore and Officer Ferraro at Poudre Valley Hospital.
Once SLATTON was decontaminated at Poudre Valley Hospital, I advised him of his Miranda Rights by reading
them directly off of the card issued to me by my department and asked if he would be willing to speak with me
regarding the incident. SLATTON verbally acknowledge that he understood his rights and said he would be
willing to speak with me.
SLATTON advised me that he was at the Lincoln Center for a sorority social with his girlfriend. While at the
Lincoln Center, SLATTON said he was approached by an adult, who he believed to be associated with the
sorority. The adult confronted him about having a flask on him, which he indicated that he did not. SLATTON said
he was asked to leave along with his girlfriend because she was not 21 years old. SLATTON said he was
re-contacted by the adult while his girlfriend was in the bathroom crying. SLATTON told the adult that she could
check him for a flask, which he said she upset her. At that time, the adult flagged down a police officer (Officer
Hopkins) and said he needed to leave. SLATTON said he then walked out of the building, just directly outside of
the exterior doors and was waiting to order an Uber.
SLATTON said he was approached by Officer Hopkins, who he didn't recognize a police officer. SLATTON said
Officer Hopkins told him that he had been told to leave the premise. SLATTON said he told Officer Hopkins that
he was getting an Uber, but that it would take a couple minutes for his ride to show up. SLATTON said he was
then immediately sprayed with pepper spray by Officer Hopkins. SLATTON said he just tried to get away from
him. SLATTON told Sergeant Moore that he was not asked for his identification and was not told that he was
under arrest. SLATTON also indicated that he was sprayed and then struck with a baton. SLATTON said he did
not have an argument with his girlfriend at all during this incident and she was only upset about being kicked out
of the event.
I was contacted by Officer Hopkins and asked if I could retrieve SLATTON girlfriend's phone and hotel room key.
SLATTON provided me with the phone and key, which I later gave to Officer Ferraro and was returned to
SLATTON's girlfriend. When SLATTON was cleared by medical personnel at Poudre Valley Hospital, he was
escorted to Officer Ferraro's marked patrol car, which was parked in front of the emergency room entrance. I

performed a search of SLATTON's person incident to arrest and placed the contents of his pockets into a clear
plastic bag. Officer Ferraro and I then transported SLATTON to the Larimer County Detention Center. With the
assistance of Officer Ferraro, I completed the necessary paperwork, booking SLATTON into the Larimer County
Detention Center on charges of CRS 18-4-504, Third Degree Trespass; CRS 18-8-103(1a), Resisting Arrest; and
CRS 18-8-104(1a), Obstruction. These charges and the information for the warrantless affidavit was provided to
me by Officer Hopkins.
My involvement in this incident was captured on my Axon body camera and booked into evidence under FC283-1
through FC283-5. The above narrative is a synopsis of my involvement of this incident. For further detail, please
review my Axon body camera footage.
No further action by this officer.

On 12/03/16, at approximately 2128 hours, I was on uniformed foot patrol in Old Town Fort Collins. I was
assigned to the District 1 policing team and was walking with District 1 Officer Matt Schuh when we overhead
Officers Todd Hopkins and Brandon Barnes involved in a foot pursuit near the Lincoln Center. Officer Schuh and I
ran to my marked police car at the District 1 substation and responded emergent to the area where Officer
Hopkins last saw his suspect, Howes and Magnolia Avenue.
Officer Hopkins had advised via radio that he last saw the suspect running southbound near the US Bank off of
Magnolia between Mason and Howes Streets. The suspect was described as a tall white male with blond hair
wearing a dark suit. Officer Hopkins said he had pepper sprayed and used a baton to strike the suspect.
I knew the suspect was likely dealing with the effects of OC (oleoresin capsicum), thus having a difficult time
blending in with other citizens that had not been pepper sprayed. As I drove my patrol car near the US Bank, I
saw a tall white male in a dark suit bending down with his hands on his knees who appeared to be having
difficulty breathing. I parked my patrol car and started walking toward the male, identifying myself as a Fort
Collins Police officer. I ordered him down to the ground and he complied willingly. I placed the male into
handcuffs while Officer Schuh acted as a cover officer.
An unknown citizen attempted to hand Officer Schuh a cell phone that he said belonged to the suspect. That
citizen was trying to leave so he handed me the cell phone. The suspect was acting semi-cooperative, spitting,
and yelling at everyone on the scene. Believing I was going to have to address him again in order to physically
restrain him, I set the cell phone down on assisting Officer Stratton's police car. In the chaos of the scene and
dealing with the suspect, I did not notify Officer Stratton immediately about the cell phone.
I stayed on scene acting as a cover officer. I transported Officer Hopkins back to his patrol vehicle for paperwork.
The suspect was turned over to medical personnel and transported to the hospital accordingly. Officer Stratton
eventually left the scene, still with the cell phone on his patrol car. Officer Harres, who was at the hospital with the
suspect, called me over the phone and asked about the suspect's cell phone. It was not until then that I
remembered it had been placed on Officer Stratton's patrol car.
I contacted Officer Stratton, who eventually found the cell phone. It had fallen off his car and was damaged. I
notified Sergeant Moore about the phone being damaged as soon as I discovered the information.
I was wearing my department issued Axon Flex Camera during my contact with the suspect in this investigation. I
