RE: REQUEST TO VACATE PORTIONS OF RIGHTS OF WAY
Attached for your review and comment is a sketch showing a right of way (cross walk) that was
dedicated by the Indian Hills Subdivision, First Filing plat that is proposed for vacation.
Although this area is label as "cross walk" on the plat it is legally considered right-of-way. The
portion of right-of-way proposed for vacation is not currently paved and/or constructed as a
driveway or street. The City is pursuing this vacation as the area is not needed for a sidewalk
connection.
At this time the area is not proposed to be retained as an easement, but it certainly can be if there
are utilities currently within this area or planed to be located here in the future. Please let me
know if you have any problem with the right of way vacation and if any of it would need to be
retained as easement. Sign and return any comments to Sheri L. Langenberger in the
Development Review Center by July 6, 2009. If we do not hear from you by this date, we will
assume you have no objections to the proposed vacation. Please call Sheri at 221-6573 if you
have any questions. Thank you.
