Issue: 01/10/2014: This property was developed in the county and recently annexed into the City. Under the
annexation policy the street in front of this property remains the obligation of the property owners for
maintenance, until such time as the street is brought up to City standards (curb, gutter, sidewalk, width and
pavement design).

Issue: 01/10/2014: As identified above Bueno has not been constructed and improved to City street standards.
This property is responsible for improving the adjacent portion of Bueno, not just because of the annexation
policy, but also the City Code requires this at the time of development or redevelopment of the property prior to
issuance of a building permit. To accommodate the industrial local street cross-section this property will need
to dedicate additional 6 feet of row along the frontage of the property. Sample dedication formats and

Issue: 01/10/2014: In accordance with City Code Section 24-95 a property is responsible for improving the street
frontage adjacent to the property at the time of development/redevelopment prior to the issuance of a building
permit or as identified in a development agreement. In lieu of designing and constructing the improvements at
this time we can enter into a development agreement that identifies that this is still an obligation and at such
time as there is a project or special improvement district is formed to complete these improvements that the
owner will participate.

contact Engineering Development Review to get a copy of the information for development agreement sheet, so
we can gather the owner and property information needed to start drafting this document. Larimer County
Recording fees will apply as this document once signed will be recorded at the county.

Issue: 04/23/2014: The right-of-way dedication and the development agreement need to be completed prior to
approval of this minor amendment. For the deed - the documents (legal, sketch and deed document) will need
to be reviewed - once they are prepared please submitt them directly to me for review. For the Development
Agreement - I need to know the legal name of the entitiy that owns the property, the type of entity (a Colorado
limited liabiltiy compancy, a Delaware Corporation, an individual...), the legal name of the person autherized to
sign for the owner, and then if their is a developer in addition to the owner I need to know the same information
for that entity. Once I have that information I can complete a draft agreement that can be provided for your
review.

Certification, signed by me.
2. ORIGINAL Development Agreement, signed by Matthew Rheingold, Manager of
5739 Bueno LLC, the owner of the property.
3. Check payable to City of Fort Collins in the amount of $250.00 for processing
costs for the Deed of Dedication for Right of Way.
4. Check payable to Larimer County Clerk & Recorder in the amount of $21.00 for
recording fees for the Deed of Dedication for Right of Way.
5. Check payable to Larimer County Clerk & Recorder in the amount of $51.00 for
recording fees for the Development Agreement.
The enclosed materials should satisfy the engineering requirements for the Minor
Amendment and should allow you to sign off on this application. Please confirm that has been
