DEED OF DEDICATION FOR RIGHT-OF-WAY
KNOW ALL MEN BY THESE PRESENTS: That the undersigned Miramont Fort Collins LLC, being the owner
of certain real property in Larimer County, Colorado legally described at Reception Nc 20130024A50 in t1je Larimer County
Records, in consideration of Ten Dollars ($10.00) in hand paid, receipt of which is hereby acknowledged, and other good and
valuable consideration, does hereby dedicate, transfer, and convey to the City of Fort Collins, Colorado, a Municipal
Corporation, whose mailing address for purposes of this Deed is P.O. Box 580, Fort Collins, CO 80522, for public use forever a
permanent right-of-way for pubic street purposes in the City of Fort Collins, County of Larimer, State of Colorado, more
particularly described on Exhibit "A" attached hereto and by this reference made a part hereof.
it is understood by the undersigned that, by acceptance of this dedication, the City of Fort Collins does not accept the
duty of maintenance of such right-of-way until permanent improvements have been made and the City has accepted such
improvements. Unless otherwise specifically agreed by the City, the City does not assume the duty of maintenance of sidewalks,
curbs and gutters, or parkways.

DESCRIPTION:
A tract of land being dedicated as right-of-way being a portion of Tract A, Replat of
Drake Park, located in the Northeast Quarter of Section 26, Township 7 North, Range
69 West of the Sixth Principal Meridian, City of Fort Collins, County of Larimer, State
of Colorado being more particularly described as follows;
Considering the North line of Tract A, Replat of Drake Park as bearing South
89°26'43" East, and with all bearing contained herein relative thereto:
BEGINNING at the Northwest Corner of a parcel of land as described by Reception
Number 852860, said point also being on the North line of said Tract A; thence along
said North line, South 89°26'43" East, 154.54 feet; thence continuing along said North
line along a tangent curve concave to the Southwest having a central angle of
21 °02' 22", a radius of 15.00 feet, an arc length of 5.51 feet and the chord of which
bears South 78°55'32" East, 5.48 feet; thence departing said North line, North
89°26'43" West, 159.93 feet to a point on the West line of said Reception Number
852860; thence along said West line, North 00°33' 17" East, 1.00 feet to the POINT OF
BEGINNING.
The above described right-of-way contains 158 square feet more or less and is subject
to all easements and rights -of -way now on record or existing.
