All,
The H.O.A of The Landings (Southeast of Horsetooth and JFK) has requested the vacation of a portion of an existing
utility and drainage easement. Attached for your review and comment is an exhibit showing the proposed easement
vacation on Tract A, First Replat of the Landings, First Filing. The HOA is proposing an new building to the pool deck,
however, the existing pool deck was built without vacating any easements. This proposal will vacate the existing pool
deck as well as the area for the new building.
Please let me know if you have any comments by Monday November 3rd . If I do not hear from you by this date, we will
assume you have no objections to the proposed vacation. If you have questions related to this vacation request please
let me know.

That's good. I was wondering if the project manager knew about the requirements for an increase in impervious area. I
have attached a handout that we have at the building department that breaks it down for him. This isn't an issue for the
easement vacation but it will be for the building permit.

I just called the project manager and he will send a revised drawing showing the private pipe. They surveyed the area
and won't be disturbing this area. This area will not be a part of the easement vacation.

I had guessed the same as you however the pipe and swale need to be in an easement. It looks like they may be building
something over the pipe north of the pool. The pipe should be shown on their plan.

See attached screen shot below. It looks like they are reconfiguring everything south of the actual pool as well as maybe
changing the location of the ramp connection. The black rectangle is the proposed building, while the red lines I believe
is some sort of awning/patio covering? I'll try to get more clarification from the developer.

Marc,
Attached is a snap shot of our inventory system. As you can see there are several storm drain pipes on the site. I'm not
exactly sure which ones are within the easement area to be vacated. It appears that the pipe shown in gold which
indicates it is privately maintained is probably within the area of vacation and then following the black line which is a
swale is probably within that area as well. These pipes should be located in a drainage easement provided for the pipes
and swale. The pink line is also a storm drain pipe shown to curve around the tennis courts which probably isn't correct
because I don't see any manholes indicating a change in direction of the pipe. Storm drain pipe usually can't be installed
on a curve so I have a hunch it is a straight shot and probably crosses under the tennis court. Not sure if that is even in
the area to be vacated.
So the bottom line is the pipes and swales need to remain in easements. The email did indicate a new proposed
building. Without plans to comment on I have no idea how it might affect the drainage and the existing pipe. The one
drawing might be showing the new building but nothing is labeled so I not sure what I'm looking at. Is the black
rectangle the new building and what is the area shown with red lines? Pipes are not allowed under buildings which is
the reason for keeping an easement on the pipe. It stops people from building over them. Now if their engineer can
show a new route for the drainage that doesn't need the pipe; the pipe can be removed and the easement area can be
vacated.
I have also attached the Replat which indicates the blanket easement on Tract A as "reserved as perpetual easements
for utilities and drainage facilities". That probably should have been routed for others to review as well.
