DESCRIPTION OF AREA TO BE VACATED:
A tract of land, being a portion of Tract E, Evergreen Park Subdivision, located in the
South half of the Southwest quarter of Section 1, Township 7 North, Range 69 West of the
6°i P.M., Larirner County, Colorado, being more particularly described by the following
boundary lines:
Considering the West line of the Southwest quarter of said Section 1 as bearing N
00°00'00" E, and with all bearings contained herein relative thereto, commencing at the
Northeast corner of Old Town North Subdivision, which bears S 53°36'45" E 3203.97 feet
from the West Quarter Corner of said Section 1; thence 229.85 feet along the arc of a curve
to the right having a radius of 510.00 feet, a central angle of 25°49'21 ", and a long -chord
which bears S 28°06'38" W 227.91 feet to the TRUE POINT OF BEGINNING; thence
76.23 feet along the are of a curve to the right having a radius of 510.00 feet, a central

RE: REQUEST TO VACATE A PORTION OF RIGHT OF WAY
Attached for your review and comment is a sketch showing a right of way that was dedicated by
the Evergreen Subdivision that is proposed for vacation. The portion of right-of-way proposed
for vacation is not currently paved and/or constructed as a public street. The applicant is
requesting this vacation as they plan to redevelop the site with the Old Town North Subdivision
currently under the review process.
We are retaining the area proposed to be vacated as a drainage, utility and sight -distance
easement. Sign and return any comments to Susan Joy in the Development Review Center by
August 26, 2009. You may also fax your response to 221-6378. If we do not hear from you by
this date, we will assume you have no objections to the proposed vacation. Please call Susan at
221-6581 if you have any questions.
