Collins, Colorado 80521 Dear Mr. Helmick: Sent via facsimile #i 970-49&7711 September 25, 2013, Theresa Shepherd and I met with you at the Larimer County Planning office window to pick up preliminary plans for the Kechter Farm Development. You presented us copies prepared as requested. I also asked for the Zeigler Road design. You found it on page 52. Since it was within a large bundle of drawings, you asked that I request a copy from JVA Consulting Engineers. You gave me the name of the project engineer, Jason and his phone number. Additionally.yAu stated there was no r ght-o f wav (ROW) taken from our side of thf street, which is the east side. We picked up copies of sheet 52 at the JVA Ft. Collins office on Friday, September 27. After reviewing the plan for the street improvement, I noticed 2 existing ROWS identified on the east side of Zeigler Road. There were also 2 statements on the page identifying the existing ROW is based on the Fossil Creek PUD Id filing. We are located in Fossil Lake PUD. Last year, during a community meeting with the developers, we were given the street improvements drawn on aerial photos. It also showed 2 existing ROWs. When I asked why 2 ROWs, Tom Daugherty told us the top or the most easterly ROW was incorrect. 'Today I spoke with Jason Claeys, JVA Project Manager for Kechter Farm. He stated the CAD operator make a mistake with the incorrect PUD. He also said JVA had been under extreme pressure to produce the documents. When asked about the 2 existing ROWS shown, he replied the upper or the farther east ROW was incorrect. Herein lies the problem, the 60' of ROW was measured from the upper ROW not the lower ROW. According to my measurements from the lower ROW, the street improvement is now 12.50' short. It is now down to 47.50' of ROW. Jason also told me the Kechters did not want to vacate any ROW and 3.50' of ROW was coming from the east side of the street. The parkway on Zeigler Road is 4' wide on the south side of Rookery Road not 6' wide, as on the north side of Rookery. If 3.50' is taken, there will be no parkway, and the curb will be against the sidewalk. As a result, Toll Brothers performed a registered well search within a 600ft boundary of our project, in accordance with State regulations. The water well on Lot 3of Kechter Farm MLD, registered with the State of Colorado #248069, was identified in our search. We understand that this well is supplied by water from a source about 30ft below ground. The underdrain for Lot 1 drains water above the bedrock (25ft and above) which we do not believe will affect the operation of the well. Collins Planning Department regarding the ROW on the east side of Zeigler Road. I -Was assured if gib �.�.ROW was rea lmd it would come from the Kech,_ter nMn on the,WestSI&O of i e street. It appears this is the second time the Kechters have refused to vacate ROW. Zeigler Road starts to curve easterly in the middle of the drives in front of the northernmost farm house. There does not seem to be any logical reason for the curve other than to preserve the existing Kechter structures. The developers' representatives made It very clear streets with curves are not desirable with the city or county. It is apparent the Kechters' desire to sell the agriculture ground for a higher use and profit in the process. I am not opposed to the development; however, all actions created by the development have a consequence. The one that is first and foremost at this time is by the ROW where there is nothing left to take. ing Why make homeowners on the east side of Zeigler Road pay twice because the Kechter properties are too close to the street? Since the Kechters do not want to vacate any ROW„ why not just forget about Zephyer Road intersection across from Rock Park Drive? It would certainly solve many issues. Zeigler Road would not have to be improved; school children would not be put fn peril with the crossover traffic on Rock Park Drive and Crane Drive and 1,500 plus vehicles per day would not be added to Zeigler Road south of Rookery Road. In conclusion, I do not agree with any subtraction of ROW from the east side of Zeigler Road and highly recommend the closure of the intersection of Zephyer Road to Zeigler Road. The new pipe under Trilby that you are showing doesn't meet our cover requirements (minimum of 3 feet from top of pipe to top of pavement) and we would not approve this as shown. This section also is showing changes to the overall grading plan and those sheets will also need to be revised to show the revised grading you are proposing. This location (south side) was identified as a field access to the south property — does this proposal impact that? Will this still be used as a field access and is there enough room between this and the future back of lots for this to accommodate this? The addition of this pipe looks like it will impact one tree, but as long as they can just move that tree to the west and still get it planted in the area a minor amendment will not be needed for the loss of the street tree. Please let me know if you have any questions. Engineering and Stormwater will both need to review and sign off on these revisions so please send the revised sheets to both of use for review.
