A TRACT OF LAND LOCATED IN THE SOUTHEAST QUARTER OF SECTION 11,
TOWNSHIP 6 NORTH, RANGE 69 WEST OF THE SIXTH PRINCIPAL MERIDIAN;
CITY OF FORT COLLINS, COUNTY OF LARIMER, STATE OF COLORADO

1. THE LOCATION OF THIS MONUMENT WAS NOT ACCEPTED. THIS MONUMENT'S INTENT, IT APPEARS, WAS TO MARK
THE NORTHWEST CORNER OF THE TRACT OF LAND SHOWN ON THE ALTA SURVEY COMPLETED BY CHAD WASHBURN,
LS 37963, RECORDED MARCH 24, 2006 AT RECEPTION NO. 20060021570. THE GEOMETRY OF MR. WASHBURN'S
RECORDED SURVEY SHOWS THE SOUTHERLY RIGHT OF WAY OF SKYWAY DRIVE IN THE SAME POSITION AS DOES
THIS SURVEY, BUT IT IS APPARENT THAT A ROTATIONAL ERROR OCCURED WHEN THE FIELD SURVEYORS SET THE
MONUMENTS FOR MR. WASHBURN'S SURVEY. THE NORTHEAST CORNER OF THE LOT WAS PROPERLY SET, BUT BOTH
THE NW AND SW CORNERS OF THE LOT WERE SET SUCH THAT THE ANGLE FORMED BETWEEN THE GEOMETRIC
(CALCULATED) POSITION AND OBSERVED POSITION, (WITH THE NE CORNER AS THE VERTEX), WAS 0'35'45".
OTHER EVIDENCE SUCH AS FENCES AND HIGHWAY LOCATION CORRELATES THIS.
2. THE SOUTHERLY RIGHT OF WAY OF SKYWAY DRIVE WAS DETERMINED BY EVIDENCE SHOWN HEREON. AN
ADDITIONAL SIX MONUMENTS WERE FOUND ON THE NORTHERLY RIGHT OF WAY OF SKYWAY DRIVE, THESE
MONUMUNTS BEING LOT CORNERS OF SKYVIEW SUBDIVISION AND SKYVIEW FIRST ADDITION. THESE SIX MONUMENTS
ALL AFFIRM THE POSITION OF THE SOUTHERLY RIGHT OF WAY AS SHOWN. IT MUST BE NOTED THAT THE PLAT FOR
SKYVIEW CALLS THE SOUTHERLY R.O.W. OF SKYWAY DRIVE AS BEING PARALLEL TO THE SOUTH LINE OF THE
NORTHEAST QUARTER OF SECTION 11. THE BOUNDARY HAVE ACCEPTED IS BASED ON FOUND LOCAL
MONUMENTATION AND THE PHYSICAL POSITION OF SKYWAY DRIVE, AND NOT ON THE LOCATION OF THE QUARTER
SECTION LINE.
3. ACCORDING TO COLORADO LAW YOU MUST COMMENCE ANY LEGAL ACTION BASED UPON ANY DEFECT IN THIS
SURVEY WITHIN THREE YEARS OF THE DATE ON WHICH YOU FIRST DISCOVERED SUCH DEFECT. IN NO EVENT MAY
ANY ACTION BASED ON ANY DEFECT OF THIS SURVEY BE COMMENCED MORE THAN TEN YEARS FROM THE DATE OF
CERTIFICATION SHOWN HEREON.
4. THE LINEAR UNIT USED IN THIS SURVEY IS THE U.S. SURVEY FOOT.
5. NO TITLE COMMITMENT WAS PROVIDED TO THE SURVEYOR FOR THIS PLAT. EASEMENTS SHOWN HEREON ARE
BASED ON THE ALTA SURVEY RECORDED MARCH 24, 2006 AT RECEPTION NO. 20060021570. OTHER EASEMENTS
MAY EXIST ON THE PROPERTY, AND THIS SURVEY DOES NOT CONSTITUTE A TITLE SEARCH BY THE SURVEYOR OR

MASTER COORDINATE BASE, WHICH IS COMPILED FROM FIELD SURVEYED POSITIONS TAKEN WITH SURVEY GRADE GPS
EQUIPMENT. THE LOCATION AND/OR EXISTENCE OF THIS MONUMENT WAS NOT VERIFIED DURING THE COURSE OF
THIS SURVEY.
