Enclosed is a copy of letter we sent in behalf
of F. W. Michael to the City of Fort Collins, directed to the
attention of Mrs. Preble, Mayor.
Neither Mr. Michael nor I has received any response
to this letter from anyone, and, accordingly, Mr. Michael
inquired of someone in City Hall and was advised we should
take the matter up with you.
I have been instructed to state in behalf of
Mr. Michael that if this matter is not corrected before the
spring runoff, it would be his intention to construct a dike
on his property to divert any of the surface discharge from
his system. If any damage would result from his doing so,
it then would be the responsibility of the City, as it is
already, except that now it is damaging Mr. Michael instead
of someone else.
This seems a foolish thing to have to consider and,
therefore, I hope the City will take such action as makes this
step unnecessary.

In September, 1973, a letter was sent to the attention of Mayor Mabel Preble
regarding.the Michael system --surface drainage at 11.1. Prospect Street and Taft
Hill Road. On November 19, 1973, Alden T. Hill of Hill $ Hill, Attys. at Law,
sent a letter to you on the same subject. On December 4, 1973, I received a
letter from you concerning this matter.
I do not know why there were so many delays in the processing of this request.
According to our Community Development and Engineering sections, the following
facts are known:
1. The culverts were installed long before this area was in the City. Drainage
patterns have been well established in the area. The grade on Taft Hill
was established when the County road was built with a borrow ditch along
the west side. This drains to'a culvert which crosses just south of Pros-
pect. Drainage from the north and west enters the Michael drainage system
either by the culvert on the N.W. corner of the intersection or over the
road.
2. The development of the Brown Farm area is undoubtedly increasing the speed
and volume of the runoff to and through the Michael system.
3. The natural drainage in the area flows through the Michael property between
Prospect and Longsworth Road. By constructing the system of ponds, they have
in effect concentrated both the irrigation and natural drainage through the
area at one point.
4. Our drainage system mprovements will provide an outlet for storm water with
the improvement of the New Mercer canal just to the east of their area.
5. The Brown Farm Second Filing improvements included a retention pond at the
S.W. corner of Taft Hill and Prospect.

writing back to Alden Hill, I would appreciate your comments. Perhaps you will
want to contact Mr. Hill personally on this matter. I£ you desire any further

TO: Members, PLANNING AND ZONING BOARD OF FORT COLLINS
FROM: Property owners and residents, Lake Street and College Avenue
RE: Proposed variance request for a business P.U.D. on .5 acres of
land zoned B-P, located on College Avenue and Lake Street
The following paragraphs summarize our opinions and recommendations
concerning this matter. We respectfully request your careful consideration
of the items cited.
We oppose granting a variance specifically for use of the piece of land
at 121 Lake Street, presently a small home and yard, as a parking lot
for the building now owned by John Clark at 1405 College Avenue as this
violates the integrity of the residential part of this neighborhood. We
do not oppose use of the latter property for its proposed renovation as
law offices since this is in accordance with current guidelines for use
of this neighborhood. Our specific concerns are as follows:
1. The guidelines written by the Planning Director for this block
in May 1977 state that
"The area including lot 1417 and north of it generally
consists of houses which should be preserved, provided
that appropriate canrercial uses can be located within
them. The suitability of such uses should be a function
of vehicular traffic generation to a large degree and of
the compatibility between various uses to a lesser degree.
Comnercial uses on these six lots should be limited to
non -retail and only low trip generating uses not to ex-
ceed twenty (20) daily trips including those of employees."
Need for a large partking lot does not appear to be in accordance
with these guidelines.
2. The city has previously denied use of this same piece of land for
this same purpose (parking lot) when it was proposed by Henry Brack
to be used in connection with a business located on the corner
opposite (north) of the John Clark property.
3. We believe that to meet B-P requirements and to preserve valued
residential atmosphere, pieces of land to be considered as part
of a P.U.D. need to be contiguous. The parking lot parcel is
separated by at least one, and possibly two, other parcels from
that which is proposed for the law offices.

Part of the reason for the adoption of P.U.D.'s in the first place is
to Promote developmnt in an organized manner and to protect housing
from encroachment of non-residential establishments. We agree with
the applicants that a larger P.U.D. develogrent could possibly be considered
for sane time in the future and that conceivably a parking lot would be
included in such a plan. Houever, it is premature to direct the content
of this plan, and, at this time it is not compatible with P.U.D. requirements
or appropriate for this small resident ] neighborhood to have a large
Parking lot situated in its center. Therefore, we urge that this
variance be denied.

Not long ago the City of Fort Collins installed a
culvert under West Prospect Street, and Lari er County
installed a culvert under Taft Hill Road at th'e inter-
section of Prospect and. Taft- Hill Road. As a result,

The result of the City's action in surfacing its streets
and in not providing stogy sewers in the area has been to

retaining dams have been washed out and destroyed. We believe
the responsibility for this damage rests on the City of Fort
Collins because of the failure to consrr�act storms se�,aers to
accommodate the development of the areas to the North and West.
