Dear Don,
In December, 1972, you completed a 12" water main in front of Markley
Motors on South College Avenue. At that time there was no existing water main
either to the north or south. For this reason, the pipe you installed was
not tied into any City water main, and there was no water available to fill
your 12" main, or to disinfect and test it.
An attempt was made to pressure test the line with air but this failed.
You will recall that you made an agreement with the City, whereby the City
allowed you to postpone pressure testing the main. This was with the stipu-
lation that at such time as your 12" water main was connected to the City water
distribution system, you would be responsible for any necessary repairs to your
untested, unapproved pipeline.
On March 15, 1976 the Water Department extended the 12" City water main
south from Steele's Market and tied into your 12" main at Markley's. Within
minutes of filling the completed main a leak was discovered on the Markley
property. You could not be reached, and because the line could not be left
shut down for any length of time, the Water Department made repairs.
I have enclosed a copy of the itemized cost of these repairs. Per the
agreement you made with the City, please make payment at your earliest conven-
ience.

We understand that you have a binding utility agreement with Orm
Sherwood covering the installation of water and sewer mains on
South College, Monroe and Mason Streets, more or less surrounding
lots 11 through 14 in South Mesa Subdivision.
We would like your engineers current estimate of cost to Mr.
Sherwood if he were required to install the 8-inch water main at
this time including all street repairs, etc.
Our reason for this estimate of cost is for us to consider some
alternatives to making the 12-inch water tie on College down to
Horsetooth, which is needed in connection with improved water
transmission to H-P via the cross tie on Horsetooth.

RE: Landscaping Requirement - So. Mesa Subdivision
On Friday, June 17, 1977, Elmer Schmi dtberger was in the office; he
indicated that George Holter had recently completed a new building across
from his. He asked how it was possible that he (Elmer) had to install land-
scaping on his site, and George Holter didn't, even though they both connected
to the sewer the same day.
The backaround on the various permits is this:
1. The Horsetooth - South Mesa annexation was effective on March 25,
1977.
2. The sewer permit was taken out on March 28, 1977, by Geroge Holter
for 3509 South Mason Street.
3. There was no building permit issued by the City for that address
(apparently issued by the County).
4. No landscape plan was submitted to the City.
A landscape plan was.apparently not required at the time the sewer permit
was issued. This should have been a requirement prior to the issuance of the
sewer permit, since the building permit had already been issued in the County,
and the property annexed only a few days previously.

Gentlemen:
We hereby establish our irrevocable letter of credit in favor of the Cith of Fort Collins,
State of Colorado, a municipal corporation, hereinafter designated "City", for the account
of Mr. and Mrs. Brian R. Wingfield hereinafter designated "Developer", up to the aggregate
amount of $378.00 which amount is to be paid to the City upon demand by the City when all
of the conditions hereinbelow set forth shall occur.
It is understood that the sole purpose of this letter of credit is to secure the obligation
of Developer to install and maintain in a satisfactory condition for a period of two years
after said installation, all landscaping shown on the final landscape plan, submitted to and
approved by the City for Lot 18 of South Mesa Subdivision, a planned unit development, pur-
suant to Section 118-63 F (3) (b) (10) of the Code of the City of Fort Collins. The City
Arborist of the City shall determine if the landscaping is being maintained in a "satisfactory
condition", which determination shall not be unreasonably or capriciously made. Maintenance
of the landscaping shall include replacement where necessary.
The conditions for payment made pursuant to this credit are as follows:
1. Developer has not performed all or part of the above stated obligation after demand
by the City.
2. The City has completed said improvements and/or maintenance or is in the process of
completing same.
3. The issuer of this letter be notified immediately of any default of Developer in
performance of the above -stated obligations.
This letter of credit shall be null and void after $378.00 has been disbursed by Bank as
stated herein or on August 29, 1982 whichever occurs first.

Dear Gene:
We have noticed that a number of new vehicles have been parked on the
median separating the frontage road from College Avenue in front of your business.
This area is part of the dedicated street right-of-way and thus parking of vehicles
in the median area is not permitted.
I Can understand that several of the other b.us.ineases, in the area have not
yet dedicated the frontage road, and they can display their vehicles closer
to the road; however, we are working to obtain the frontage road dedication
in the entire area.. This would permit uniform set -back, and completion of
the frontage road. In the meantime we must ask you to remove the vehicles from
the median area. Thank you.

Street from approximately 275 feet south of Monroe Drive to approximately
35 feet north of Monroe Drive has been shut -down by the City Inspector. This
action was taken because the plans, for the construction have not been
approved by th.e City Engineer, at this time, as required by Chapter 99, Section 6,
Paragraph D of the Code of Ordinances of the City of Fort Collins. This
order will remain in force until the plans for this, construction project have
been signed and approved by the City Engineer.

A recent check of Mason Street just north of Horsetooth Road shows
that the portion of the pavement over the sewer main you installed is
badly in need of repair, due to trench settlement and improper asphalt
patching.
I have talked with Mr. Roblin and he indicated to me that he had
informed you of this matter well within the one year guarantee period
and that this work was never satisfactorily completed. Please look at
the street and make the necessary arrangements to have it repaired as
soon as possible.
