MEMORANDUM

In reference to your memorandtun of April 14th and the proposed agree-
ment between the City, Osprey, and other property owners in the area,
we would offer the following comments:
Section 1, paragraph 1, page 2, 10th line from top of page: the words
"asphalt and" should be deleted.
Section 4, paragraph 1, pages 2 and 3: Exhibit C is referenced and
is intended to show the estimated expenses of the district. We be-
lieve that the method for determining how expenses are to be appor-
tioned to the various properties should be shown in the Exhibit.
Costs rarely are exactly as estimated and adjustment will undoubtedly
need to be made. This is much easier if the methodology for apportion-
ing costs is spelled out ahead of time.
Section 5, paragraph 2, page 3: We believe reference should be made
to the provisions of Chapter 16 of the Code of the City of Fort Collins.
Section 5, paragraph 4, page 4: We do not believe the City should be
burdened with keeping track of changes in property ownership since the
City has no mechanism to do so. The benefit of this paragraph is to
Osprey and we think they should bring it to our attention.
The agreement does not address the question of payment for engineering
services incurred prior to the formation of the district. It is ob-
vious that some work will have to be done to develop Exhibit C. If so,
these costs and their apportionment should be clearly shown.
In other respects, we believe the agreement is acceptable.
