Dear Mr. Scarpella:
In the utility agreement of September 6, 1977 for Scarpella Subdivision,
a number of time limits were agreed upon for the installation of street im-
provements in conjunction with this development. You, as the Developer,
agreed to install street improvements on Lake Street as shown on the utility
plans, complete with paving, curb, gutter and sidewalks prior to September
1, 1978. Additionally, you agreed to construct a temporary cul-de-sac on
Evergreen Drive as shown on the utility plans, prior to September 1, 1978.
We understand that if you have not made arrangements for the installation
of these improvements prior to the date of this letter it may not be possible
for you to comply with the September 1 deadline. If this is indeed the
case, please take the necessary steps to assure the completion of this work
at the earliest possible date.

RE: Public Improvements for
Scarpella Subdivision
Dear Mr. Scarpella:
On October 4, 1978, a letter was sent to you from Donald M. Parsons,
City Engineer, relating to improvements required for the Scarpella
Subdivision pursuant to an Agreement entered into between yourself and
the City.
In that Subdivision Agreement, you obligated yourself to make certain
public improvements within the Subdivision which were indicated on the
utility plans for the Subdivision.
Mr. Parsons, in his letter of October 4, indicated that he would
extend the time for compliance with the Agreement from September 6,
1977 to November 1, 1978. The improvements yet to be installed
include the temporary cul-de-sac which requires both a base course and
an asphalt mat, and the paving, curb, gutter and sidewalk on Lake
Street. To date, these improvements have not been completed and
accepted by the City.
This letter is to give you notice that these improvements must be
completed immediately or the City will be forced to take legal action
to enforce the Agreement. I would like a reply from you by Wednesday,
November 15, 1978, indicating when these improvements will be com-
pleted and what steps you have taken to complete them. If we do not
hear from you within that time period, we will be forced to pursue
other remedies.

Dear Mr., Rule,
This letter will confirm our discussion yesterday regarding the improvements
on Scarpella Subdivision. The water and sewer mains serving the lot adjacent
to lake Street have been installed and have been accepted by the City. The
only expenses involving water and sewer for this lot should therefore be the
normal fees for individual services.
Regarding the street improvements on Lake, the curb, gutter, sidewalk and pav-
ing were to be completed prior to September_1,1978 according to the subdivision
agreement. These improvements must be installed as soon as the weather permits.
In addition, I indicated that the City had installed a temporary mat on the
portion of Lake Street adjacent to this property to reduce the hazard created
by this unimproved section during the construction on Prospect Street. This
temporary asphalt mat cannot be accepted as part of any permanent public
improvements unless it can be determined that such construction conformed to
the design and specifications of the approved utility plans for Scarpella
Subdivision. The City will not seek reimbursement for the temporary improvements
we have installed on Lake Street.

Mr. Merle Rolfs owns the property at 2412 Evergreen. He purchased it from
Mr. Frank Scarpella. Scarpella subdivided the property with the utility
agreement signed Septenber.6th, 1977. That agreement provided that a
temporary cul-de-sac would be developed and improved at the end of Evergreen
by September 1, 1978. Mr. RDlfs apparently purchased the property unaware
of that.
Mr. Rolfs asked if he can have a temporary gravel approval, that is, put in
the cul-de-sac as gravel rather than paving. Please let me have your thoughts
in terms of haw we can handle the situation. I think it is important to
respond to Mr. Rolfe' problem, without violating some important principal.
Please give me an answer by Wednesday, August 23rd.

Dear Mr. Rolfs:
Fbllowing our conversations with you regarding the status of the im-
provements required for your property on Evergreen Drive, Lot 2 of Scarpella
Subdivision, we discussed the various alternatives in considerable detail.
It appears from these discussions that the most logical and beneficial course
of action for you would be to install, in conjunction with your request for
a certificate of occupancy, the concrete improvements (curb, gutter and
sidewalk) fronting your lot in the configuration of the permanent cul-de-sac.
Also, you would install the base and asphalt mat of the permanent cul-de-sac
to the centerline of Evergreen Drive at the appropriate final grades, and
install the base course of the temporary cul-de-sac south of the centerline.
The City will continue to pursue the construction of the appropriate improve-
ments for Lot 3 of this subdivision with Mr. Scarpella.

Dear Mr. Parsons:
Referring to the utitlity agreement of September 6, 1977 for
Scarpella Subdivision. As Developer it was agreed to make the
improvements prior to September 1, 1978. 1 am in the process
of making improvements as stipulated, and would appreciate a
little extension of deadline to comply. Last week Gurweil
Construction completed the installation of 6" water line across
development, which precedes the installation of temporary cul-de-
sac. `The 100' of paving on take was done.The lots 1 b 2 were
sold to builders who are arranging finances to build. I will
expedite the improvements and keep you advised.

Dear Frank,
I wish to discuss the sidewalk and pavement at the above -
referenced property.
I am in receipt of your signed agreement with the City to
develop said property. I am not aware of any written document
passing along this responsibility.
To obtain a building permit one must be sure these items
have been attended to. This does not, however, relieve you of
the financial obligation. What you must be aware of is that I
do not wish to build on this. lot, but rather sell it to a pro-
spective investor or builder.
If you were to act immediately, you would find the work
could be done for the least cost due to the development in
Wildwood. I have gotten the following bid prices to assist in
the final stages of development of Lot 1.
Scott Dunn Excavatin --$65 - $120 to grade area and dispose
of asphalt existing depending on depth to cut. 226-2832
Sterling Paving --Road base and asphalt mat, $3.60 per square
yard in place if done at time of Wildwood paving. Bob Gardner,
482-7854.
Sipes Concrete --Sidewalk, curb and gutter, labor and
material, $7.00 per lineal foot. Dave Sipes, 493-5550
I trust your signature is good and you would fulfill your
promise to the City by performing the required tasks. If you
passed along the responsibility verbally, you should see to it
John Simmons keeps.your name clear. Certainly you can see my

Dear Mr. Scarpella:
Thank you for your September 15th letter regarding the
public improvements for Scarpella Subdivision. I under-
stand that an extension of the deadline agreed upon in
the utility agreement of September 6, 1977 will be
necessary to complete the required construction.
However, please advise us immediately if you feel
any of the improvements cannot be completed prior
to November 1, 1978.
The improvements yet to be installed include the temporary
cul-de-sac, which requires both a base course and an
asphalt mat, and the paving, curb, gutter and sidewalk
on Lake Street. You indicated in your letter that the
paving was completed. The City had installed a temporary
asphalt mat on the portion of Lake Street which fronted
your property to reduce the hazard created by this unimproved
section during the construction along Prospect Street. This
temporary asphalt mat cannot be'accepted as part of any
permanent public improvements unless it can be determined
that such construction conforms to the design and specifications
of the approved utility plans for Scarpella Subdivision.
