REQUEST TO VACATE AN EASEMENT
Attached for your review and comment is a sketch showing Lot 1 of the Sherwood Mews PUD,
located at 411 N. Sherwood St.( see attached vicinity map). The 6 foot wide utility easement
running diagonally accross the southwest corner of the Lot 1, as shown on the attached drawing,
is being proposed for vacation. The owner of the property is requesting the easement vacation
because they wish to build garage in this location. The owner is willing to dedicate an alternative
easement if it is necessary around the garage.
Please sign and return any comments to Michael Dean in the Development Review Center by
December 22, 1997. If we do not hear from you by this date, we will assume you have no
objections to the proposed vacation. Please call Michael Dean at 221-6750 if you have any

MEMORANDUM

RE: Request to vacate an easement at 411 N. Sherwood
This request can be approved by Light and Power after the following take place:
1. A 6 ft. wide easement is provided across the south end of lot 1 as shown on the attached sketch.
2. A 6 ft. wide easement is provided across lot 2 as shown on the attached sketch.
3. The existence of the 15 ft. utility and emergency access easement shown on lot 2 is verified to Light and
Power by the requesting party.
4. The electric services to 401, 403, and 415 N. Sherwood are converted to underground, and the existing
overhead line across 411 N. Sherwood is removed.
The easements must be prepared on Light and Power easement forms which can be provided on request. As
consideration to the property owners granting easements, Light and Power will pay $10.00, plus provide the
underground service. Once the easements are signed by the owners, the notarized original easement forms
must be returned to Light and Power. The utility will then contact any mortgage holders for Consent and
Subordination. Light and Power will obtain City Council approval and record the easements at the Larimer
County Courthouse.
Light and Power has a program to convert the entire electric system to underground by the end of 2004. This
neighborhood is not in the 1998 schedule for conversion. Normally if a customer needs an electric service
placed underground prior to Light and Power converting the neighborhood, the customer must pay the costs.
There are some variables involved, but I estimate the total costs for the above items to be $2000.00 to
$2500.00. Easements can be difficult to obtain, and in this case some otherwise difficult services can be
undergrounded if the easements are provided. Therefore, if the requesting party can provide or obtain the
above easements, I will authorize that all these costs will be borne by Light and Power. Actual construction
of the underground system will not be possible until the spring construction season (appx. March, 1998). I
believe that either or both US West phone and TCI cable TV may also have overhead lines in the requested
easement to vacate. Light and Power would offer joint trench to each of these utilities, but cannot guarantee
that either would choose to use it.

Sherwood Mews PUD
The owner of 411 N. Sherwood has granted an easement along his south property line. Light and Power
has now completed the rerouting of the electric system (underground) within the new easement. As far as
this utility is concerned, the requested vacation of the existing easement (aka tract A), can be approved.
