Dear Mike,
Thank you for meeting with me to discuss the Timberline Road
improvements required to be built with the Sunstone Phase 4
development. The primary concern for both the City and Super Group,
Inc. is that the Timberline improvements are made in a timely manner
and that adequate funds have been secured to make the improvements.
Our initial estimate, based on cost estimates (attached) submitted by
Flatiron on the original improvements, would indicate that the local
share of 12' width to full base, with curb, gutter and sidewalk along
920' of frontage would be approximately $30,000. Secondly we agreed
that the appropriate share of the improvements to be attributed to
Sunstone 4 is $20,000 and $10,000 to the commercial tract between
Timberline and Stoney Creek Drive. To secure those improvements,
Super Group, Inc. would pay the City $20,000 with the recording of the
amended development agreement and place a letter of credit with the
city for $12,500 (125% of the remaining costs) for the balance of the
improvements.
More current bids which have been lower may adjust the costs downward.
However we can use the $30,000 estimate to proceed with the amended
development agreement.
The intent is to have sufficient funds available to make the
Timberline improvements on either the City's schedule or as Super
Group, Inc. or the future developer may request to be completed with
the development of the commercial tract. Depending on the timing of
development, the City may desire to complete the Timberline
improvements and could request the remaining funds held as a letter of
credit or if the developer desires to complete the road improvements,
they may also require payment of those funds held by the City.

This is to certify that the storm drainage facilities
designed for the referenced subdivision have been completed
in accordance with the plans and specifications prepared by
this office, except for the following items:
1) Final grading of the 40 foot drainage swale between
Timberline Road and Caribou Dr.
2) Seeding of the swale sides.
3) East 100' (approx.) of the swale walkway, just West of
Caribou Drive.
Items 1 and 2 have been delayed due to weather conditions
since the delay caused by relocation of the walkway. They
are scheduled for completion as soon as weather permits.
Item 3 is on hold until the City and the property owner
whose fence encroaches into the swale have reached agreement
and the fence is moved back out of the swale. A precise
time frame is unknown at this time for Item 3.

As requested, we have reviewed your letter of April 30, 1990
and the attached letters of August 31, 1989 and September
29, 1989.
It is apparent that the individual builders and/or homeown-
ers in Sunstone have not in the past, and are not now prac-
ticing good procedures in grading of lots and placing land-
scaping and sprinkler systems in relationship to their
homes. A letter from you on this matter can only be benefi-
cial.
As for the past problems outlined in the City's letter to
you on August 31, 1989, you will recall we discussed the
items of concern in this letter previously. We had reviewed
these on site and found thzt the gutters were, in fact,
blocked with dirt and debris in some locations. These have
since been cleaned and are not now a problem. As for the
three inches of water standing in the cross pan,.after
cleaning it now holds between 1/4 ir�chand 1/2 inch of water
at the deepest point, which is not untypical and does not
create a "pool" of water that wil'1 stand on asphalt.
Again, as stated before, the Engineer, Development
Contractor, and Developer cannot be responsible for the

have no control over final lot grading or house foundation
elevations that may affect drainage.

they formally answer the inquiry regarding the installation of
curb and gutter in Flagstone. The grades in that area have been
checked a number of times and the problems seem to have been
alleviated in part by the owners cooperation on their
landscaping and watering. Super Group, Inc. is planning to do
a final sweep and clean up in conjunction with the completion of
the Sunstone Fifth project.

Dear Mr. Baland,
As per your request, this letter is to explain why the work on the gutters
of the walk along Stoney Creek Drive is considered part of the warranty
work.
First and foremost, it is the responsibility of the Construction Inspection
Division to insure that the citizens receive the best quality product which
will save its design life with low maintenance costs. High quality, law
future maintenance cost construction has always been a concern of
Engineering Inspection and with the ever increasing cost for maintenance
the need to "do it right the first time" is igmrtant.
Secondly, it is the responsibility of the contractor to provide the best
possible product that he can, to include the design standard of the curb,
gutter and walk.
The grinding of the gutter outlined for this street is not something new
and different, for example in the Chaparral P.U.D. Subdivision, the
concrete contractor ground several areas that caused ponding of water in
the gutter. Also, this particular contractor had to remove and replace
several areas that could not be corrected by grinding.
At this point I would like to refer you to Section 6, Paragraph 3, Page
P-13 of the City Standards for streets and sidewalks. It refers to the
inspections of all construction work performed on a project in the
right-of-way. It states that the City Engineer may make or require other
inspections as deemed necessary to ascertain compliance with the City
Specifications and Design Standards.

With this in mind, I chose to have the gutters flooded to determine where
the water was ponding and to make a decision as to what steps would be
necessary to correct the problem. Grinding the areas around the joints
seemed to be the easiest, most cost-effective corrective measure. There
are also a few areas that will require removal and replacement to correct
the ponding.
Here again, this is something that has been done in the past. I do agree
with you that there are some areas on other City streets that have similar
Problems. But, that is not the point. We are striving to prevent these
types of problems from reoccurring and in doing so, prevent small problems
from developing into larger, more expensive ones.
Hopefully, this letter explains the City's position in this matter. The
City would like to let you know that your cooperation is greatly
appreciated.

Super Group, Inc. at the northeast corner of Timberline Road and
Caribou Drive.
We have informed the buyers, a partnership managed by Mr. Dan
Eckles, of the imminent improvements to Timberline Road, the
impact of these improvements on the subject property, and the
approximate costs of these improvements.
The negotiated sales price reflects Mr. Eckles and his partners'

Dear Ms. Hopkins:
This letter is in response to your concern of the fill
materials which have been and will be utilized for the
overlot grading at Sunstone Village P.U.D., Fourth filing.
I inspected the primary borrow area at Brittany Knolls on
June 9, 1989. A severely weathered sandstone containing low
to moderate amounts of clay was observed in the stockpiles
and in the areas being excavated. These materials, in our
opinion, appear to be of a low to non -expansive nature and
will produce a good subsoil for supporting the foundations,
slabs, and roadways at the site. One area containing a lr,
brown topsoil -like clay was observed in small deposits at
the site. The Contractor was informed to avoid the clayey
soils at Brittany Knolls except for use as topsoil and/or
backlot fill.
Two other borrow areas were inspected on June 9. Two(2)
stockpiles at Collendale Business Park (directly West of
Sunstone) consisted of silty and clayey materials. The
Contractor was told to avoid using these materials where
they may be located under the foundations. The third borrow
area is located at the 'Pace' project located Southwest of
Harmony and Lemay. The Contractor was informed by me that
the reddish sand/clay mixture could be used where located
under foundations and roadways and to avoid using the brown
clay soils in those areas.

After trying without success to reach you on Monday regarding the
above -referenced Agreement, I will try to communicate my thoughts
to you in this memorandum.
With respect to Paragraph D(i), you make reference in the first
sentence to "certain" street improvements and "certain terms.',
Are there any terms in addition to those that are subsequently
set forth in the Agreement?A& Should we not define the street
improvements with greater particularity?
I have made some other suggestions with regard to the opening
paragraph, subparagraph (i), which, hopefully, speak for them-
selves. With respect to "Part 2" which I have re -titled "(B)," I
am very doubtful that you will be able to obtain a "non -expiring"
letter of credit, and even if you were, I think it would violate
the rule against perpetuities. That rule provides that, if an
interest is to be valid, it must vest within 21 years of lives in
being at the time of the grant. Could you settle for some speci-
fied period of time?
I am not sure I understand what you are trying to say in the last
paragraph of subparagraph (i). I think we ought to sit down and
discuss what you intend by that paragraph, and perhaps I can dic-
tate some language that will accomplish that purpose.
The changes to subparagraph (ii) are fairly straightforward. I
think perhaps reference to "this development" is more clear than
reference to "the property," especially when the Development
Agreement refers to off -site property that is not part of the
subject development.
Changes to the signature provisions are minor and speak for them-
selves.

Enclosed with this letter are certain plans and legal
descriptions for the above -referenced project.
Designs. The plans which accompany this letter
represent what I understand to be the final, completed
plans for the project, as prepared by Landmark
Engineering, Ltd.
It is my understanding that the City will pay
Landmark directly for Landmark's design and field
varification services. In this regard, I should
mention that because of the extensive review process
and design changes required by the City, such costs
have increased from approximately $4,500,00 to somewhat
over $10,000.00.
Legal Descriptions. Also enclosed with this
letter are the legal descriptions for the permanent
easement and the temporary construction and drainage
easement, prepared by Landmark. After our preliminary
discussions with City staff, G-T and Mr. Chandler, it
was my understanding that the City will contact Mr. Tom
Chandler, the landowner involved, directly, concerning
the negotiation and payment for these easements.
Timberline Easement. Regarding easements, I should
mention that as the preliminary Timberline outfall plans
were reviewed, additional right-of-way needed for
Timberline was discussed and called out on this plan. I
understand that the City will acquire a strip of land on
the east side of Timberline Road, to facilitate this
project from G-T Land. Negotiation and acquisition should
be finalized with them.

I'm working with Connell to schedule the concrete
work in Sunstone Phase IV. We, (Dave Stringer, you
and I) had agreed this would be a logical time to
include the pedestrian walk in Sunstone Phase I that
connects Sunstone Drive to the new school. The ease-
ment for the walk is between lots 10 and 11. I'd
like your suggestion on how the walk should be installed
to protect the drainage between the houses and not
undermine the walk. It appears that the home on lot 11
is at a slightly higher grade, with drainage also toward
the rear yards.
Two options seem feasible:

We will stake the area later this week and do the flat -
work within the next two to three weeks. You can call

As you are aware, one of the conditions of the Sunstone 4th Filing
development is to install a pedestrian path along the drainage channel
adjacent to the north property line. In the process of surveying the
location for this path, it has been determined your south property line
fence encroaches into the drainage tract. In order to accommodate the
installation of the pedestrian path and landscape the channel, the fence
must be removed.
The intent of this letter is to provide official notification for the
removal of the fence and all other encroachments in the right-of-way or
storm drainage tract as outlined below:
1. 6-foot wood stockade fence encroaches approximately 7-feet into the
drainage tract.
2. 4-inch diameter P.V.C. pipe outlets into storm drainage tract. This
pipe must be removed or made to comply with specific criteria as
determined by Storm Drainage Utility.
3. For installation of the pedestrian path, removal of the dirt piles
which encroach into the tract, is required.
4. Removal of underground sprinkler system encroaching in drainage tract.

In addition, City Code Chapter 23, Article 3, Division 3, (copy enclosed)
requires such encroachments to be removed within ten (10) days after
receipt of this notice. If at such time the encroachments are not removed,
the City may exercise the right to perform any necessary work and assess
the cost to the property owner.
