As you are aware, Colorado State University is proceeding with the renovation of the
Washington School at 223 South Shields Street. As part of that project the alley located along
the north boundary of the property will be improved with paving and concrete pans.
The concrete pans being installed will convey run off drainage to and across the Northeast
Corner of the University's property prior to entering the City's curb and gutter system along
South Shields Street. The purpose of this route is to allow the run off to enter a storm water
quality pond area prior to exiting University property. This is similar to the existing drainage
patterns; the difference is the low flows will be controlled by the drainage pan and they will
receive treatment for water quality.
Colorado State University acknowledges that the pan and drains as designed will convey run off
from properties other than that owned by the University. Colorado State University will be
responsible for the maintenance and oversight of the run off as it crosses the University property.

The City of Fort Collins (the "City") has requested that Colorado State University ("CSU") dedicate to the
City, at no cost, a parcel of real estate as a right-of-way on Shields Street along the boundary of the
Washington School property (223 S. Shields Street) to allow for widening of South Shields Street. CSU is
willing to grant such request upon satisfaction of the conditions set forth below:
The City has determined and approved that South Shields Street should be widened from its
present right-of-way boundary;
The City has prepared plans and specifications for the widening of South Shields Street, which
plans include a legal description and sketch showing the exact location and size of land needed
from CSU for such right-of-way widening, not to exceed a width of twenty-one (21) feet on CSU
property;
3. The City has provided such plans and specifications to CSU, through the Facilities Management
Department, for CSU's review and opportunity to provide recommendations for revision of such
{Man affecting CSU and/or CSU-property, either directly or indirectly, and which final plain Thal;
include a legal description and sketch of real estate needed from CSU for such widening project
to be included as an exhibit on any deed of conveyance by CSU to the City;
4. The City has identified a funding source for the widening of Shields Street on CSU property and
has appropriated funds for the design of the Shields Street widening, excluding any
administrative costs associated with the dedication of right-of-way by CSU to the City;
5. The Board of Governors of the Colorado State University System has given CSU a
such dedication of right-of-way to the City; and approval for
