I wanted to take the opportunity to follow up on our discussion that we had the week of June
22nd, 2009. In that conversation we discussed matters relating to the impending federally funded
Shields Street overlay project that will occur from Prospect Road to Mulberry Road. The
improvements for this section of Shields Street are scheduled to begin as early as August 2009.
I have identified two sanitary service connections and curb and gutter reconstruction along
Shields Street north of Birch Lane related to your development. Both of these improvements will
necessitate asphalt patches. As mentioned, the City will waive the pavement impact fee
(approximately $1350.00) for these patches if work is completed in advance of the Shields Street
overlay. Furthermore, you will be spared the expense of connecting your two patches which
would be a requirement if the overlay project was not occurring. Otherwise, as per the City's
excavation permit requirements, a triple impact fee would be assessed if the road is cut into or
otherwise impacted within the next five years. Based on approved plan dimensions for utility
cuts, that is a $4000 permit fee, which does not include the actual cost of repairs.
The City will not require the completion of your Development Construction Permit in order to
make any improvements on Shields that could be coordinated before resurfacing begins.
Furthermore, we will suspend the applicable inspection fees related to the improvements and
instead collect at the time of DCP as well.
Although the City cannot directly contribute to your development project, we are willing to
forego some expenses in the spirit of collaboration and attempt to keep the uniformity of our new
streets intact. I strongly suggest that you consider completing this utility work in advance of the
scheduled overlay. Your immediate response is greatly appreciated as we are on a very tight
timeline both with the repaving project and the start up of fall semester classes at CSU. You can
