B'128O P 1 49 1 51 I I COUNTY OF LARINIER 1984 JUL 13 N 3: 17 STATE OF COLORAOO ORDINANCE NO. 71 , 1984 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING PORTIONS OF A UTILITY EASEMENT IN TRACT A OF THE WILDERLAND CONDOMINIUMS, A MULTI -FAMILY P.U.D. WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate portions of a utility easement located in Tract A of the Wilder - land Condominiums, a Multi -family P.U.D. set forth in more particular below; and WHEREAS, there are currently no utilities located in these portions of the easement; and WHEREAS, all utilities have been contacted and have no problems with the vacation request; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that those certain portions of a utility easement located in Tract A of the Wilderland Condominiums, a Multi -Family P.U.D., set out more particularly as follows, to wit: Easement Vacation 1 A portion of a 15 foot wide utility easement, in Tract A, of Wilderland Condominiums, a Multi -Family P.U.D., according to the recorded plat thereof, City of Fort Collins, Larimer County, Colorado being described as follows: Beginning at the Northwest Corner of said Wilderland Condominiums; thence Southerly along the Easterly line of said Wilderland Condominiums, South 90000' 00" East, 60.00 feet; thence South 65035'50" East 235.71 feet, thence South 12°20'00" East, 128.62 feet; thence departing said Westerly line North 77°40'00" East, 185.26 feet to the South- westerly corner, of a 15 foot wide utility easement, and the True Point of Beginning of this description; thence Northerly along the Westerly line of said 15 foot utility easement, North 03°37' 43" East, 7.00 feet; thence departing said Westerly line, South 86°22'17" East, 35.00 feet to the Easterly line of said 15 foot utility easement, thence Southerly along said Easterly line, South 03037'43" West, 7.00 feet to the Southerly line of said 15 foot utility easement; thence Westerly along said Southerly line North 86022'17" West, 35.00 feet to the point of beginning of this description. WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate a portion of a utility easement located in Wilderland Condo- miniums, PUD, set forth in more particular below; and WHEREAS, this vacation would accommodate a building that would other- wise encroach upon the easement; and WHEREAS, all utilities have been contacted and have indicated no problems with the vacation; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that that certain portion of a utility easement located in Wilder - land Condominiums, P.U.D., set out more particularly as follows, to -wit: A portion of a 15 foot wide utility easement in Tract A of Wilderland Condominiums a Multi -Family P.U.D., according to the recorded plat thereof, City of Fort Collins, Lariner County, Colorado, being described as follows: Beginning at the Northeasterly corner of Gilgalad Way as platted in said Wilderland Condominiums Multi -Family P.U.D.; thence North 55°32'45" West 54.00 feet to the Westerly right-of-way line of said Gilgalad Way; thence departing said Westerly right-of-way line North 55°32'45" West 15.00 feet to the Westerly line of a 15 foot wide utility easement and the True Point of Beginning of this description; thence Northerly along said Westerly easement line North 34°27'15" East 44.09 feet; thence North 07°34'20" West 135.69 feet to the Southerly line of a 20 foot wide sanitary sewer easement; thence Easterly along said Southerly easement line North 36°30'10" East 7.19 feet; thence departing said Southerly easement line South 07°34'20" East 142.77 feet; thence South 34027'15" West 46.01 feet; thence North 55032'45" West 5.00 feet to the point of beginning of this description.
