ORDINANCE NO. 134, 1980
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A SIX FOOT UTILITY EASEMENT,
FIRST REPLAT OF WHALER'S COVE
WHEREAS, the City has been petitioned to vacate a six foot utility
easement as platted in the First Replat of Whaler's Cove, more particularly
described below; and
WHEREAS, Wood Brothers Homes has dedicated a ten foot utility easement
to take the place of the existing six foot utility easement; and
WHEREAS, the six foot utility easement is no longer needed; and
WHEREAS, it appears that the rights of the residents of the City of
Fort Collins will in no way be prejudiced or injured by the vacation of
said utility easement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the following utility easement, more particularly described as
follows, to -wit:
A six foot (6') utility easement along the northerly
right of way line of Whaler's Way; said easement
running along the southerly lot lines of Lots 41, 42,
43, 44, 45, and 45 A beginning at the westerly lot line
of Lot 41 and ending at the easterly lot line of Lot 45
A,
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading and ordered pub-
lished this 7th day of October, 1980 and ,to be presented for final passage
on the 21st day of October, 1980. / n
