ORDINANCE NO. _20_, 1978
BEING AN ORDINANCE AMENDING ORDINANCE NO. 128,
1977, AND CHANGING THE DESCRIPTION OF THE PORTION
OF THE EASEMENT VACATED BY SUCH ORDINANCE
BE IT ORDAINED BY THE COUNCII, OF THE CITY OF FORT
COLLINS:
That Ordinance No. 128, 1977, be and the same hereby
is, amended to change the description of the portion of the
easement vacated by such ordinance to read as follows:
The Southerly four (4) feet of the Northerly twenty
(20) feet, except the Easterly ten (10) feet and the
Westerly six (6) feet thereof, all in Lot 1 of Harvard
Subdivision, Second Filing, in the City of Fort Collins,
Colorado.
Introduced, considered favorably on first reading and
ordered published this 21st day of February, A.D. 1978, and
to be presented for final passage on the 14th day of March,
A.D. 1978.

WHEREAS, Section 2 1.5 of the Land Use Code of the City of Fort Collins authorizes the
Director of Community Planning and Environmental Services to vacate certain easements by

resolution or by approval of replats containing notation of such dedication, and

WHEREAS, the Owner has requested that the City vacate a portion of a utility easement

on Lot 2, Harvard Subdivision, 2i' Filing, located on the South College Avenue Frontage Road

on the west side of College Avenue, south of Harvard Street and north of Swallow Road, more

particularly described on Exhibits "A" and "B"; and

WHEREAS, the vacation has been reviewed and approved by the pertinent City

Departments, which departments report no objections to the vacations-

NOW, THEREFORE, be it resolved by the Director of Community Planning and

Environmental Services of the City of Fort Collins, that a portion of a utility easement on Lot 2,
Harvard Subdivision, 2ntl Filing, located on the South College Avenue Frontage Road on the
west side of College Avenue, south of Harvard Street and north of Swallow Road, which portion
is more particularly described on Exhibits 'A" and "B," attached hereto and incorporated herein
by this reference, is hereby vacated.
Passed and adopted at an administrative hearing held by the Zoning Supervisor as the
delegee of the Director of Community Planning and Environmental Services of the City of Fort
