Location/Purpose of Encroachment: Applicant wishes to construct a wood deck
into a portion of an easement adjacent to his house.
Applicant Agrees to submit with this permit application a sketch, drawing,
or plan that illustrates the location of the proposed encroachment,
obstruction, or other structure in the easement area.
Applicant has read this permit and agrees to abide by the current City of Fort
Collins Standard Specifications,and to any, -special conditions, restrictions and
regulations that may be imposed by the CityrQineer.

Conditions: This encroachment as
an impact on the Boxelder Sanitation
shown on the attached drawing may have
District's ability to properly maintain it's
facility within this easement. Therefore, the District's Board of Directors reviewed
the request to encroach into the utility easement located on lot 62, Hearthfire 1st
Filing. The request to encroach, as depicted in the following drawing was
presented, and shows offsets of piers 5' feet from the District's sewer line.
Please be advised the District assumes no liability for improvements that
encroach in a utility easement, and requests that this encroachment permit be
made part of the public record related to this property. Additionally,
potential damage caused by this encroachment to the District's line and/or any
other utility company facilities occurring during or after construction shall be the
responsibility of the permitee, and the permitee by acceptance of this permit,
agrees to hold harmless the City and the District for any such damage. The
permittee and/or his assigns must obtain proper locates of all infrastructure
constructed in the easement prior to commencing construction. If any utility
provider's ability to properly maintain or install it's facility is inhibited by the
encroachment, said utility company may remove the encroachment and shall
have no obligation to replace the encroachment.

ASSIGNMENT OF STORM DRAINAGE EASEMENT
The undersigned, HEARTHFIRE ASSOCIATION, INC., a Colorado nonprofit membership
corporation, whose principal business address is c/o Ponderosa Management, 2601 S. Lemay
Avenue, Suite 7-408, Fort Collins, Colorado 80525 ("Grantor"), in consideration of Ten Dollars
($10.00) in hand paid, receipt of which is hereby acknowledged, and other good and valuable
consideration, does hereby assign all of its right, title and interest in that Storm Drainage Easement
over and through Lot 47, HEARTHFIRE P.U.D. FIRST FILING, City of Fort Collins, County of
Larimer, State of Colorado, recorded on May 16, 2000 at Reception No. 2000031877 of the records
of the Larimer County Clerk and Recorder, to the CITY OF FORT COLLINS, COLORADO, a
municipal corporation ("Grantee") provided that the obligations of maintenance of the storm
drainage facilities within such easement shall remain with the Grantor.

STORM DRAINAGE EASEMENT
The undersigned. HEARTHFIRE. INC., a Colorado corporation ("Grantor"), being the owner
Lot 47. HEARTHFIRE P.U.D. FIRST FILING, City of Fort Collins, County of Larimer. State of
Colorado ("Grantor's Property'7, in consideration of Ten Dollars ($10.00) in hand paid, receipt of
which is hereby acknowledged, and other good and valuable consideration, does hereby transfer and
convey to HEARTHFIRE ASSOCIATION, INC., a Colorado nonprofit membership corporation,
a permanent easement over Grantor's Property for the purposes of constructing, instal ling, operating
and maintaining underground storm drainage utilities over and through the Grantor's Property, said
easement being more particularly described on Exhibits A and B attached hereto and by this
reference made a part hereof
The Grantee accepts the grant of the easement described herein and all maintenance
responsibilities therefor.
