Attached for your review and comment is a sketch showing Lot 50 of Hearthfire PUD, First
Filing, located at 3209 Town Center Court which is south of Douglas Road and East of County
Road l3. The 20 foot rear lot utility easement is proposed for vacation, as shown on the attached
drawing. The owner of the property desires to build a deck which would extend into this area.
Please sign and return any comments to Sheri L. Wamhoff in the Development Review Center by
April 14, 2004. if we do not hear from you by this date, we will assume you have no objections

CORPORATION
Shear Engineering Corporation is requesting a vacation of easement for the above referenced
address. The vacation of easement request is for the existing twenty -foot (20') utility easement
along the rear property line. Shear Engineering Corporation has reviewed the utility records for
Lot 50 and believes that there are no existing utilities in this easement.
I have attached the sketch plan titled "20' Utility Easement Vacation Exhibit" for your reference
per the Vacation of Rights -of -Way and Easement Document provided to us by the City of Fort
Collins.
I have also attached an 8Yz x I of Lot 50 from the Master Utility Plan of the approved Final
Utility Plans for Hearthfire P.U.D., First Filing, by Shear Engineering. The attached 8%z x 11 of
the Master Utility Plan does not show a 20' utility easement at the rear of the lot. I believe that
the 20' utility casement represented in Lot 50 was an oversight by the surveyor at the time of
recording the final plat.
