LOT 2. OF MULBERRY AND LEMAY CROSSING FILING NO. 2
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain easements, by resolution or by approval of
replats containing notation of such vacation; and
WHEREAS, the Owner has requested that the City vacate a portion of the 24 foot
wide access easement on Lot 2, Mulberry and Lemay Crossing Filing No. 2, which
proposed vacation is more particularly described on Exhibit "A"; and
WHEREAS, the vacation request has been reviewed and approved bythe pertinent
City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of
Fort Collins that a portion of the 24 foot wide access easement on Lot 2, Mulberry and
Lemay Crossing Filing No. 2, which easement is more particularly described on Exhibit "A",
attached hereto and incorporated herein by this reference, is hereby vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the
City of Fort Collins held this 16th day of September A.D. 2004.

PROJECT DESCRIPTION:
Request to vacate a portion of the 24 foot wide access easement on Lot 2 of Mulberry
and Lemay Crossing Filing No. 2, located south of Magnolia Street and east of 12th
Street.
RECOMMENDATION: Staff recommends approval of Resolution PZ04- 21
EXECUTIVE SUMMARY:
The Owner has requested the vacation of a portion of the 24 foot wide access
easement on Lot 2 of Mulberry and Lemay Crossing Filing No. 2 because the existing
easement does not work with the approved building layout for the Home Depot Store.
A new access easement that accommodates the store layout will be dedicated. The
utility companies have been contacted and have no problems with the proposed
vacation.

EXECUTIVE SUMMARY:
The Owner has requested the vacation of two portions of the 24 foot wide emergency
access and utility easement on Lot 2 of Mulberry and Lemay Crossing Filing No. 2
because the existing easement does not work with the approved building layout for the
Home Depot Store. A new emergency access and utility easement that accommodates
the store layout will be dedicated. Due to an ownership split of the property the
easement vacations and the dedication of the new easements needs to occur in severa
pieces. The utility companies have been contacted and have no problems with the
proposed vacation.

WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain easements, by resolution or by approval of
replats containing notation of such vacation, and
WHEREAS, the Owner has requested that the City vacate three portions of the 24
foot wide access easement on Lot 2, Mulberry and Lemay Crossing Filing No. 2, which
proposed vacations are more particularly described on Exhibit "A" and "B"; and
WHEREAS, the vacation request has been reviewed and approved by the pertinent
City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of
Fort Collins that three portions of the 24 foot wide emergency access and utility easement
on Lot 2, Mulberry and Lemay Crossing Filing No. 2, which easements are more
particularly described on Exhibits "A" and "B", attached hereto and incorporated herein by
this reference, are hereby vacated.

WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain easements, by resolution or by approval of
replats containing notation of such vacation; and
WHEREAS, the Owner has requested that the City vacate three portions of the 24
foot wide access easement on Lot 2, Mulberry and Lemay Crossing Filing No. 2, which
proposed vacations are more particularly described on Exhibit "A" and "B"; and
WHEREAS, the vacation request has been reviewed and approved bythe pertinent
City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of
Fort Collins that three portions of the 24 foot wide emergency access and utility easement
on Lot 2, Mulberry and Lemay Crossing Filing No. 2, which easements are more
particularly described on Exhibits "A" and "B", attached hereto and incorporated herein by
this reference, are hereby vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the

EXECUTIVE SUMMARY:
The Owner has requested the vacation of three portions of the 24 foot wide emergency
access and utility easement on Lot 2 of Mulberry and Lemay Crossing Filing No. 2
because the existing easement does not work with the approved building layout for the
Home Depot Store. A new emergency access and utility easement that accommodates
the store layout will be dedicated. Due to an ownership split of the property the
easement vacations and the dedication of the new easements needs to occur in several
pieces. The utility companies have been contacted and have no problems with the
proposed vacation.
