WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate a portion of a utility easement located adjacent to Lots 14 and 15, Indian Hills P.U.D. set forth in more particular below; and WHEREAS, this vacation enables the petitioner to replat the adjacent areas into three Lots; and WHEREAS, this is a zero lot line plan and no area within the lots can be an easement; and WHEREAS, there are no utilities located in the easement and all utilities indicate no problem with the vacation request; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that that portion of a certain utility easement located adjacent to Lots 14 and lei, Indian Hills P.U.D., set out more particularly as follows, to wit: A part of the private drive and utility easement located in Indian Hills West P.U.D., which begins at the northeast corner of Lot 14 of said Indian Hills West P.U.D., and runs thence S 84*00' W 48.00 feet; thence N 06°00' W 5.15 feet; thence S 89°52'30" E 48.28 feet to the point of beginning, containing 124 square feet. be, and the same hereby is, vacated, abated and abolished. AND A PORTION OF THE INDIAN HILLS VILLAGE P.U.D. WHEREAS, the owner of Lot 108 and a portion of Tract A of the Indian Hills West P.U.D. and a portion of Tract A of the Indian Hills Village P.U.D. has requested abandonment of the rights to develop said 'Lot and portions of said tracts in accordance with the approved planned unit developments for Indian Hills West P.U.D. and Indian Hills Village P.U.D.; and WHEREAS, pursuant to Section 29-527 of the Code of the City, the Board has considered said request and has determined that the portions of the Indian Hills West P.U.D. and Indian Hills Village P.U.D. which :remain developed or to be developed in accordance with the previously approved P.U.D. plans will continue to qualify for approval as a planned unit development pursuant to the criteria and requirements of Section 29-526 of the Code; and WHEREAS, the Board has further determined that in so approving the aforesaid abandonment, the City's rights of ownership of or practical ability to utilize any previously dedicated street, easement, right-of-way, or other public area or public property will not be denied or diminished to the detriment of the public good. NOW THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING BOARD OF THE CITY OF FORT COLLINS, that, pursuant to Section 29- 527(a)(2), Lot 108 and a portion of Tract A of the Indian Hills West P.U.D. and a portion of Tract A of the Indian Hills Village P.U.D., all as more particularly described on Exhibits "A" and "B" attached hereto and incorporated herein by this reference, are hereby removed from said planned unit developments and the rights to development said property in accordance with the approved Indian Hills West P.U.D. and the Indian Hills Village P.U.D. plans is hereby abandoned.
