ORDINANCE NO. 42 , 1978
BEING AN ORDINANCE VACATING AND OTHERWISE ABANDONING
A SIX_ FOOT UTILITY EASEMENT ON THE WESTERNMOST PORTION
OF LOT 5, HARVARD SUBDIVISION, FIRST FILING
WHEREAS, the City of Fort Collins has been requested to vacate an
unused six (6) foot utility easement located on the westernmost portion of
Lot 5 of the Harvard Subdivision, First Filing; and
WHEREAS, the easement for which vacation is requested is not
needed for municipal purposes nor will the same be needed for municipal
purposes in the future.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the following described utility easement, to -wit:
The western six (6) feet of Lot 5, Harvard S--::bdivision,
First Filing, City of Fort Collins, County of Larimer,
State of Colorado,
be, and the same hereby is, abated, vacated and abolished.

RE: Vacation of land,
Mason Street.
Dear Roy:
As per our conversation today, February 24, 1978, which included
my partner, John Schofield, I am sending this letter.
Harvard Development would like to request vacation of 10 feet of
the existing 50 feet Mason Street Right -of -Way. This 50 feet
was origionally part of the Harvard Development Company
P.U.D. The vacation of the 10 feet was discussed at the onset
of the Improvement District No. 73 at a meeting of all the
land owners boardering Mason Street. The date of this meeting
was June 10, 1977 and a letter was sent to the city on June 13,
1977. The Improvement District was approved by City Council
in December 1977.
To further help other effected land owners, and to help save
time for all concerned, land owners, your time, and other city
employees, I would like to see all this taken care of at one
time.

Dear Paul.
Pursuant to our conversations this week, please consider this
request for vacation of the six foot utility easement along the west side
of lot number five of the Harvard Subdivision First Filing.
As you will recall from our discussions, this vacation is being
requested to accomodate our building on this lot. Roy Dingman in
conjunction with Jim Stewart's office discovered that the Mason Street
right of way would require fifty feet (instead of the planned and
approved forty feet), in this area to accomodate the Larimer County
Canal J2, being out of its right of way.
In checking the revised site plan, our building plans were based
on the forty foot right of way as approved by your department.
As we also discussed, Harvard Development Co. will be glad to grant
the six foot easement as requested by Doug Martine of your Light and
Power Department.
As always, your promptattention to this matter will be appreciated.
