Re: The vacation of part of a ten (10) foot utility and drainage easement
Dear Mr. and Mrs. Paben,
This letter is in response to your request to vacate part of the ten (10) foot utility and
drainage easement that currently runs along the north property line of your lot. At the
time I received your request, I routed a letter to the various departments that this
process would directly affect, stating your intentions. Please find enclosed copies of
the comments and concerns we received from these various departments. After
reviewing the comments, I have concluded that we cannot approve of the vacation of
the portion of the ten (10) foot utility and drainage easement. I would, however,
recommend that you contact each of the various departments to see if you can pursue
any other options.
If you should have any further questions or concerns, please do not hesitate to contact
this office.

ORDINANCE NO. 135, 1980
OF THE COUNCIL OF THE CITY OF FORT COLLINS
BEING AN ORDINANCE VACATING A UTILITY
EASEMENT IN THE FOX MEADOWS SUBDIVISION
WHEREAS, Medema Homes, Inc., has requested that the easements along
the southerly sides of Lots 14 and 21 and the northerly sides of Lots 15
and 20 in Block 4 of the Fox Meadows Subdivision be vacated; and
WHEREAS, the original intent of these easements was to provide a
location for the installation of an eight inch (8") water main from
Arctic Fox Drive to Wapiti Road; and
WHEREAS, pursuant to requests by the City's Engineering staff, the
location of the water main was altered thereby eliminating the need for a
utility easement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that those certain utility easements lying along the southerly
sides of Lots 14 and 21 and the northerly sides of Lots 15 and 20 in Block
4 of the Fox Meadows Subdivision more particularly described as follows,
to -wit:
Easement 1. Being the southerly six feet of Lot 14,
Block 4, excepting the easterly and westerly six
feet thereof, containing 519.5 square feet, more or
less.
Easement 2. Being the southerly six feet of Lot 21,
Block 4, excepting the easterly and westerly six
feet thereof, containing 519.5 square feet more or
less.
Easement 3. Being the northerly six feet of Lot 15,
Block 4, excepting the easterly and westerly six
feet thereof, containing 519.5 square feet, more or
less.
