WHEREAS, the vacation request has been reviewed and approved by the pertinent
City and private utilities, and they report no objections.

I am writing to request the vacation of a six foot wide utility easement located along the west
property line of 4223 South Mason Street. The easement lies along the west he of Tract "A" of
the Fossil Creek Commercial Plaza and is adjacent to the Burlington Northern Railroad right-of-
way.
Mr. Jim Petersen, the owner of the property, told me there are no utilities in this easement,
and he would like to place his new building adjacent the railroad right-of-way.
Attach is a legal description of the proposed easement vacation and a map of the area showing
the proposed vacation.

Dear Kerrie,
I am writing to request the vacation of the east three feet of a six foot wide utility easement
located along the west property line of 4223 South Mason Street. The easement lies along the
west line of Tract "A" of the Fossil Creek Commercial Plaza and is adjacent to the Burlington
Northern Railroad right-of-way.
Mr. Jim Petersen, the owner of the property, has discussed this proposed vacation with TCI
and they have agreed to vacate the east half of the easement. They plan to place their existing
overhead cable underground through this area, but they will only need three feet to accomplish
that.
Attached is a legal description of the proposed easement vacation and a map of the area
showing the proposed vacation.
